Certificated Air Carrier. Lessee is a Certificated Air Carrier and Lessor, as lessor of the Aircraft to Lessee, is entitled to the benefits of Section 1110 of Title 11 of the United States Code with respect to the Aircraft; and
Certificated Air Carrier. Each Air Carrier is a Certificated Air Carrier and possesses all necessary certificates, franchises, licenses, permits, rights, designations, authorizations, exemptions, concessions and consents that are material to the operation of the routes flown by it and the conduct of its business and operations as currently conducted (the “Permits”). Each Air Carrier is a “citizen of the United States” as defined in Section 40102(a)(15) of Title 49. Neither the DOT nor FAA nor any other Aviation Authority has taken any action or proposed or, to such Air Carrier’s knowledge, threatened to take any action, to amend, modify, suspend, revoke, terminate, cancel, or otherwise affect such Permits, in each case, in a materially adverse manner.
Certificated Air Carrier. Each Air Carrier is a Certificated Air Carrier and possesses all necessary certificates, franchises, licenses, permits, rights, designations, authorizations, exemptions, concessions, approvals, frequencies, Slots, and consents that are material to the operation of the routes flown by it and the conduct of its business and operations as currently conducted (the “Permits”). Each Air Carrier is a “citizen of the United States” as that term is defined in Section 40102(a)(15) of Title 49 or successor statute. Neither the DOT nor FAA nor any other Governmental Entity has taken any action or to such Air Carrier’s Knowledge, proposed or threatened to take any action, to amend, modify, suspend, revoke, terminate, cancel, or otherwise affect such Permits, in each case, in a materially adverse manner. Except as set forth in Schedule 3.06, no written notices of violations of the FARs or of DOT rules, regulations or requirements have been issued and are pending.
Certificated Air Carrier. Each Air Carrier is a Certificated Air Carrier and possesses all necessary certificates, franchises, licenses, permits, rights, designations, authorizations, exemptions, concessions and consents which are material to the operation of the routes flown by it and the conduct of its business and operations as currently conducted (the "Permits"). Neither the DOT nor FAA nor any other Aviation Authority has taken any action or proposed or, to such Air Carrier's knowledge, threatened to take any action, to amend, modify, suspend, revoke, terminate, cancel, or otherwise affect such Permits and Op Specs, in each case, in an adverse manner.
Certificated Air Carrier. Lessee will continue to be a certificated air carrier authorized to engage in scheduled air transportation under the Federal Aviation Act.
Certificated Air Carrier. Sublessee is a Certificated Air Carrier.
Certificated Air Carrier. Mesa shall at all times remain a Certificated Air Carrier. Exhibit 10.6
Certificated Air Carrier. The Borrower shall maintain at all times its certificate of public convenience and necessity under Section 41101 of the Aviation Act, or any successor provision, as and for so long as such certificate is a condition to the applicability of Section 1110 of the United States Bankruptcy Code to aircraft owned or leased by the Borrower.
Certificated Air Carrier. The Borrower is a Certificated Air Carrier and possesses all necessary certificates, franchises, licenses, permits, rights, designations, authorizations, exemptions, concessions and consents that are material to the operation of the routes flown by it and the conduct of its business and operations as currently conducted (the “Permits”). The Borrower is a “citizen of the United States” as defined in Section 40102(a)(15) of Title 49. Neither the DOT nor FAA nor any other Aviation Authority has taken any action or proposed or, to the Borrower’s knowledge, threatened to take any action, to amend, modify, suspend, revoke, terminate, cancel, or otherwise affect such Permits, in each case, in a materially adverse manner.
Certificated Air Carrier. Buyer is and will remain a ------------------------ Certificated Air Carrier. Buyer holds and will continue to hold all material licenses, certificates, permits and franchises from the Canadian Government necessary to authorize Buyer to engage in international commercial air transport and to carry on its business as a commercial air carrier of passengers and cargo.
