Certification by Contractor. If DCAMM so requests in writing, CONTRACTOR shall certify to DCAMM on a monthly basis, that payments owed by CONTRACTOR to Subcontractors and not under dispute have been paid in a timely fashion and that CONTRACTOR has satisfied its current payment obligations regarding the New Equipment/Systems.
Certification by Contractor. I certify under penalty of perjury that the information provided herein is true and accurate. I further acknowledge that during the term of my Agreement with the District, if I learn of additional information which differs from the responses provided above, I promise to forward this additional information to the District immediately."
Certification by Contractor. In each Invoice, Contractor shall certify as follows: “There are no known Liens (or such Liens are bonded over) outstanding at the date of this invoice, all amounts that are due and payable to any third party (including Subcontractors) with respect to the Work as of the date of this invoice have been paid or are included in the amount requested in this invoice, and, except for those bills not paid but so included and amounts disputed between Owner and Contractor, there is no known basis for the creation of any Liens except in respect to payments to Subcontractors withheld for proper reasons. Contractor hereby waives and releases, to the extent of the receipt of payment requested in this invoice, any right to any Lien with respect to payment for such portion of the Work included in this invoice.”
Certification by Contractor. Contractor certifies that all information and data provided by Contractor to the Company in order to obtain this Agreement or in response to the Company requests for information and data are accurate, complete and current as of the date of execution of this Agreement.
Certification by Contractor. Contractor acknowledges that Contractor has been notified of the immigration compliance requirements of CRS 8-17.5-101 et.seq. (House bill 06-1343), and hereby CERTIFIES THAT:

On behalf of Contractor, I hereby certify that, to Contractor’s knowledge, the information provided in this form is true, accurate, and complete, and that during the term of this Agreement, if Contractor learns of information that differs from that provided above, including but not limited to the hiring of new personnel who are current SFUSD employees or Board members, or former SFUSD employees or Board members within the past one (1) year, Contractor will promptly update this form with the District.
Certification by Contractor. By its signature below, Contractor hereby certifies to County that as of the date of this AESS Pilot System Acceptance Certificate, it has satisfied all conditions precedent in the Agreement, including the Exhibits thereto to the completion of the AESS Pilot System Software (the Deliverable) set forth above, including satisfaction of the acceptance criteria applicable to such Deliverable and County’s approval of the Work performed in connection with the achievement of such Deliverable. Contractor further represents and warrants that the Work performed in respect of the described Deliverable has been completed in accordance with the Exhibit B (Statement of Work). Attached hereto is a copy of all supporting documentation required pursuant to the Agreement and Exhibit B (Statement of Work), including any additional documentation reasonably requested by County. Certification by Contractor. Each Contractor’s Invoice:
(a) shall describe: (i) the completion of the Work as described in the Progress Payment Schedule; (ii) the related Progress Payments set forth on the Progress Payment Schedule that are then due as of the end of the immediately preceding calendar month; and (iii) any other amounts then payable by Owner to Contractor under Article 17 or any other provision hereof and, without limiting Owner’s right to dispute any amounts requested for payment;
(b) shall include documentary evidence of the completion of each such discrete portion of Work described in such Contractor’s Invoice sufficient for Owner to verify that such Work has been completed;
(c) shall include Contractor’s and Major Subcontractors’ Partial Release and Waiver of Liens and Claims in compliance with Exhibit H;
(d) shall include the Critical Path Schedule and Monthly Progress Report in accordance with Section 4.29 and Section 4.30, except to the extent they have previously been provided for the applicable month; and
(e) shall include supporting documentation (not on the face of the invoice), which addresses the amounts attributable to Sales Taxes. It being understood and agreed by Contractor that any Contractor’s Invoice that is inaccurate or incomplete or that lacks detail, specificity or supporting documentation required by this Article 7 shall not, to the extent of such deficiency, constitute a valid request for payment. Each Progress Payment shall be due and payable only to the extent it is supported by the completion of the corresponding individual discrete portion of Work, it being acknowledged and understood that no Progress Payment shall be made for any partially or improperly completed discrete portions of Work or for Work that remains subject to Owner’s review and inspection rights in accordance with Article 12. Notwithstanding the foregoing, in no event shall the cumulative amount paid for any month exceed the cumulative amounts of the Progress Payments payable for such month pursuant to the “Expenditure Schedule” set forth on the Progress Payment Schedule plus any applicable Change Orders.
