CMA General Conditions Amendments. The CMA General Conditions are hereby amended as follows: the underlined text is hereby added to the CMA General Conditions. 10.1 follows: A new subsection (q) is hereby added to Section 7.6.1.1 of the CMA General Conditions as (q) There occurs any Persistent DB Contractor Maintenance Default, TxDOT delivers to DB Contractor written notice of the Persistent DB Contractor Maintenance Default, and either (i) DB Contractor fails to deliver to TxDOT, within 45 days after such notice is delivered, a remedial plan meeting the requirements for approval set forth in Section 9 of Exhibit 9 to the CMA or (ii) DB Contractor fails to fully comply with the schedule or specific elements of, or actions required under, the approved remedial plan.

  • Modifications and Amendments The terms and provisions of this Agreement may be modified or amended only by written agreement executed by all parties hereto.

  • Amendments; Waivers No provision of this Agreement may be waived or amended except in a written instrument signed, in the case of an amendment, by the Company and each Purchaser or, in the case of a waiver, by the party against whom enforcement of any such waiver is sought. No waiver of any default with respect to any provision, condition or requirement of this Agreement shall be deemed to be a continuing waiver in the future or a waiver of any subsequent default or a waiver of any other provision, condition or requirement hereof, nor shall any delay or omission of either party to exercise any right hereunder in any manner impair the exercise of any such right.
