Common use of Collection Suit by Trustee Clause in Contracts

Collection Suit by Trustee. If an Event of Default specified in Section 6.01(1) or (2) occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors for the whole amount of principal of, premium on, if any, and interest, if any, remaining unpaid on, the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

Collection Suit by Trustee. If an Event of Default specified in Section 6.01(1clause (1) or (2) of Section 6.01 above occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors for the whole amount of overdue principal of, premium onpremium, if any, interest remaining unpaid on the Notes and to the extent lawful, interest on overdue principal, premium, if any, and interest, if any, remaining unpaid on, the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

If an Event of Default specified in Section 6.01(16.01(a)(1) or (2) with respect to the Notes occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors Issuer for the whole amount of principal of, premium onpremium, if any, and interest, if any, interest remaining unpaid on, on the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

Collection Suit by Trustee. If an Event of Default specified in Section 6.01(16.1(1) or (2) occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors any Subsidiary Guarantor, if any, for the whole amount of principal of, premium onpremium, if any, and interest, if any, interest remaining unpaid on, on the Notes and interest on overdue principal and, to the extent lawful, interest and such further 76 70 amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

Collection Suit by Trustee. If an Event of Default specified in Section 6.01(1) or (2) occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors any Subsidiary Guarantor for the whole amount of principal of, premium onpremium, if any, and interest, if any, interest remaining unpaid on, on the Notes Securities and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

If an Event of Default specified in Section 6.01(16.01(a), (b) or (2c) occurs and is continuing, the Trustee is authorized to may recover judgment in its own name and as trustee of an express trust against the Company or the Guarantors for the whole amount of principal ofprincipal, premium onpremium, if any, and interestinterest remaining unpaid on the Securities and interest on overdue principal, premium, if any, remaining unpaid on, the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and and, to the extent lawful, expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.

If an Event of Default specified in Section 6.01(16.01(a) or (2b) occurs and is continuing, the Trustee is authorized to recover judgment in its own name and as trustee Trustee of an express trust against the Company or the Guarantors for the whole amount of principal of, premium onpremium, if any, and interestinterest and Special Interest, if any, remaining unpaid on, on the Notes and interest on overdue principal and, to the extent lawful, interest and such further amount as shall be sufficient to cover the costs and expenses of collection, including the reasonable compensation, expenses, disbursements and advances of the Trustee, its agents and counsel.
