Common use of Commencement of Capital Maintenance Agreement Clause in Contracts

Commencement of Capital Maintenance Agreement. No later than 90 days prior to the date that is one year after Final Acceptance of the Project to be constructed under the Design-Build Agreement (the commencement of the Initial Maintenance Term), TxDOT shall issue Maintenance NTP1 to the Maintenance Contractor.

Commencement of Capital Maintenance Agreement. No later than 90 days prior to the date that is one year after Final Acceptance of the Project to be constructed under the Design-Build Agreement (the commencement of the Initial Maintenance Term), TxDOT shall either: (a) issue Maintenance NTP1 to the Maintenance Contractor; or (b) terminate this Capital Maintenance Agreement.

No later than 90 180 days prior to the date that is one year after Final Acceptance Scheduled Substantial Completion Deadline of the first Segment of the Project to be constructed under the Design-Build Agreement (the commencement of the Initial Maintenance Term)Development Agreement, TxDOT shall either: (a) issue Maintenance NTP1 to Maintenance Contractor (the “CMA Commencement Date”); or (b) terminate this Capital Maintenance ContractorAgreement. Failure by TxDOT to issue Maintenance NTP1 by such date shall be deemed a Termination for Convenience under Section 14.9.
