Communications and Information. (a) All communications to the Obligors' Agent (or any Affiliate of the Obligors' Agent) under or in connection with the Interim Finance Documents are, unless otherwise specified in the relevant Interim Finance Document, to be made by or through the Interim Facility Agent. Each Interim Finance Party will notify the Interim Facility Agent of, and provide the Interim Facility Agent with a copy of, any communication between that Interim Finance Party and the Obligors' Agent (or Affiliate of the Obligors' Agent) on any matter concerning the Interim Facility or the Interim Finance Documents. (b) No Agent will be obliged to transmit to or notify any other Interim Finance Party of any information relating to any Party which that Agent has or may acquire otherwise than in connection with the Interim Facility or the Interim Finance Documents. (c) In acting as agent for the Interim Lenders, each Agent's agency division will be treated as a separate entity from any of its other divisions or department (the Other Divisions). Any information relating to any Group Company acquired by any of the Other Divisions of an Agent or which in the opinion of that Agent is acquired by it otherwise than in its capacity as Agent under the Interim Finance Documents may be treated by it as confidential and will not be treated as information available to the other Interim Finance Parties.

Communications and Information. (a) All communications to any Obligor by a Finance Party in connection with the Security Documents are to be made by or through the Security Agent. (b) The Security Agent will not be obliged to transmit to the Beneficiaries any information in any way relating to the Security or the Security Documents or this Deed which the Security Agent may have acquired otherwise than in its capacity as Security Agent. Notwithstanding anything to the contrary expressed or implied herein, the Security Agent shall not as between itself and the Beneficiaries be bound to disclose to any Beneficiary or other person any information, disclosure of which might in the opinion of the Security Agent result in a breach of any law or directive or be otherwise actionable at the suit of any person, or any information supplied by any member of the Group to the Security Agent in its capacity as Security Agent for the Beneficiaries or any of them which is identified by such member of the Group at the time of supply as being unpublished, confidential or price sensitive information or supplied solely for the purpose of evaluating in consultation with the Security Agent whether such transaction might require a waiver or amendment to any of the provisions of the Security Documents or this Deed. (c) In acting as Security Agent for the Beneficiaries or any of them, the Security Agent’s banking division shall be treated as a separate entity from any other of its divisions (or similar unit of the Security Agent in any subsequent re-organisation) or subsidiaries (the “Other Divisions”) and, in the event that the Security Agent should act for the Parent or any member of the Group in a corporate finance or other advisory capacity (“Advisory Capacity”), any information given by the Parent, the Coordinator or any other member of the Group to one of the Other Divisions is to be treated as confidential and will not be available to the Beneficiaries or the banking division of the Security Agent without the prior written consent of the Coordinator, provided that: (i) the consent of the Coordinator shall not be required in relation to any information which the Security Agent reasonably determines relates to a Default or in respect of which the Beneficiaries to which such information is disclosed have given a confidentiality undertaking in a form satisfactory to the Security Agent and the relevant member of the Group acting reasonably; and (ii) if representatives or employees of the Security Agent receive i...

Communications and Information. (a) Residents are responsible for all policy and procedural information posted on bulletin boards and/or disseminated through University media, including website, emails, and newsletters. (b) Official University communications are sent regularly via email; therefore, students should check their University assigned email account daily. Failure to be aware of updated policies, procedures or other information does not relieve a student from responsibility or obligation.

(b) In acting as Group Security Agent for the Finance Parties or any of them, the Group Security Agent's banking division shall be treated as a separate entity from any other of its divisions (or similar unit of the Group Security Agent in any subsequent re-organisation) or affiliates (the "OTHER DIVISIONS") and, in the event that any of the Other Divisions should act for the Company or any other member of the Group in a corporate finance or other advisory capacity ("ADVISORY CAPACITY"), any information given by the Company or any other member of the Group to one of the Other Divisions is to be treated as confidential and will not be available to the Finance Parties or the banking division of the Group Security Agent without the consent of the Company, provided that: (i) the consent of the Company shall not be required in relation to any information which the Group Security Agent in its discretion determines relates to a Default or in respect of which the Finance Parties to which such information is disclosed have given a confidentiality undertaking in a form satisfactory to the Group Security Agent and the relevant member of the Group acting reasonably; and (ii) if representatives or employees of the Group Security Agent receive information in relation to a Default whilst acting in an Advisory Capacity, they will not be obligated to disclose such information to representatives or employees of the Group Security Agent in -------------------------------------------------------------------------------- 141 138 -------------------------------------------------------------------------------- their capacity as Group Security Agent or to any of the Finance Parties if to do so would breach any rule or regulation or fiduciary duty imposed upon such persons.

Communications and Information. (a) The Employer will provide a bulletin board for the exclusive use of the Union. The bulletin board shall be located in a location accessible to employees (one in the School Building and one in the Residence Building). (b) The Employer shall, where facilities permit, make available to the Union specific locations on its premises for the placement of bulk quantities of literature of the Union. (c) The Employer shall permit union communications to be delivered to employees using the electronic and physical delivery systems currently available. (d) The Employer will transcribe any information that it has generated for distribution to employees into Braille or some other appropriate means of communications if the employee requests transcription. (e) The Employer will provide an area for pick up of information from the Union and/or the Employer.

Communications and Information. To enhance communication, the Plant Manager and top Management team will meet with the Plant Committee on a monthly basis to keep them updated on plant issues. This will include updates on the key measures of the Mississauga Plant. The Union will provide an agenda of any other general issues they wish to discuss and the Company will provide a written schedule of the dates.

(b) The Agent will not be obliged to transmit to the other Finance Parties any information in any way relating to any of the parties to the Operative Documents which the Agent may have acquired otherwise than in connection with this Agreement or the other Operative Documents.

Each Beneficiary will notify the Security Agent of, and provide the Security Agent with a copy of, any communication between that Beneficiary, an Obligor or any other Finance Party on any matter concerning this deed or the Security Documents.

(ii) The Representative shall transmit to each other Holder any information obtained and any notices received or served in connection with the Warrants or this Agreement. The Representative will not be obliged to transmit to any other Holder any information relating to any party to any Issue Document which the Representative may have acquired otherwise than in connection with the Warrants or this Agreement. (iii) Notwithstanding anything to the contrary expressed or implied in any Issue Document, the Representative shall not, as between itself and the other Holders, be bound to disclose to any other Holder or other person any information, disclosure of which might in the opinion of the Representative result in a breach of any law or regulation or be otherwise actionable at the suit of any person.
