Common use of Company Capital Clause in Contracts

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (i) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (ii) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (i) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable20.3 hereof, (ii) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member or Economic Owner shall be paid interest on any Capital Contribution to the Company or on such Member’s 's or Economic Owner's Capital Account, and no Member or Economic Owner shall have any right (ia) to demand the return of such Member’s 's or Economic Owner's Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 Article XI hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s 's assets, or (iii) to own or use any particular or individual assets of the Company.

For the avoidance of doubt, nothing in this Section 3.4 shall be construed to override or (iii) contradict other rights to own dividend accrual, distributions or use any particular or individual assets of the Companyredemption payments expressly provided in this Agreement.

No Except as described in this Agreement, no Member shall be paid interest on any Capital Contribution to the Company or on such Member’s 's Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s 's Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article XII hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the CompanyCompany Assets.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article XI hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

No Except as approved by the Board and as set forth in Section 12.19, no Member shall be paid interest on any Capital Contribution to the Company or on such Member’s 's Capital Account, and no Member shall have any right (i) to demand the return of such Member’s 's Capital Contribution or any other distribution from the Company (whether upon resignation or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article XIV), or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (ii) to cause a partition of the Company’s 's assets, or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution capital contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (i) to demand the return of such Member’s Capital Contribution capital contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article XVIII hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (ii) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on the balance of such Member’s 's Capital Account, and no Member shall have any right (i) to demand the return of such Member’s 's Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (ii) to cause seek or obtain a partition of the Company’s assets, 's assets or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable20.3 hereof, (iib) to cause a partition of the Company’s assets, or (iiic) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article XI hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s assets; provided, or (iii) however, that interest restrictions in this Section shall not apply to own or use any particular or individual assets an Advance Loan, the maker of the Companywhich is entitled to receive interest as provided in Section 3.3(H).

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (i) to demand the return of such Member’s Capital Contribution or or, except as otherwise provided in this Agreement, any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof ARTICLE XVI hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (ii) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

Company Capital. No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 hereof Article X hereof, or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s assets, or (iii) to own or use any particular or individual assets of the Company.

No Member shall be paid interest on any Capital Contribution to the Company or on such Member’s 's Capital Account, and no Member shall have any right (ia) to demand the return of such Member’s 's Capital Contribution or any other distribution from the Company (whether upon resignation resignation, withdrawal or otherwise), except upon dissolution of the Company pursuant to Section 18.2 Article 12 hereof or pursuant to the Share Repurchase Plan or the Repurchase Arrangement, as applicable, (iib) to cause a partition of the Company’s 's assets, or (iii) to own or use any particular or individual assets of the Company.
