Compensatory Measures. Vegetation trimming and minor sediment removal activities are expected to have a low impact on existing environmental resources. The permanent impacts to 0.18 acre of herbaceous riparian vegetation shall be mitigated with the implementation of all best management practices and conditions described above in this Agreement. Specifically, any coastal sage scrub and the California coastal gnatcatcher habitat present within the work site shall be avoided during the nesting season of California coastal gnatcatcher to avoid potential impacts. If additional and/or unexpected impacts do occur, Permittee shall be required to submit a mitigation plan to CDFW to address these impacts within 60 days of the impacts occurring, additional compensatory mitigation measures shall be included in this Agreement, and a Lead Agency shall be identified for CEQA compliance.
Compensatory Measures. 1. A relevant authority may require a professional to be subject to compensatory measures where: (a) there exists a substantial difference between the professional's professional qualifications and the essential knowledge or skills required to practise the regulated profession in the host jurisdiction; or (b) the regulated profession in the host jurisdiction comprises one or more professional activities that cover substantially different matters from those covered by the professional's professional qualifications. 2. The relevant authority may decide between an adaptation period or an aptitude test. 3. To the extent possible and at the professional's request, relevant authorities shall provide their reasons for requiring that professional to undertake compensatory measures in writing. 4. Each Party shall ensure that, where a relevant authority requires the professional to take an aptitude test, that relevant authority schedules aptitude tests with reasonable frequency and at least once a year, where applicable.

Compensatory Measures. To compensate for adverse impacts to fish and wildlife resources identified above that cannot be avoided or minimized, Permittee shall implement each Protective Measure listed below. 3.1 At least 30 days prior to starting Project activities, Permittee shall submit to CDFW a Final Wetland Enhancement and Revegetation Plan for written approval that identifies the specific locations and details of on-site native mitigation plantings at Work Memorial Park and the Frog Pond Preserve to replace vegetation removed and impacted during Project activities. Plantings shall be installed within one year following the removal of vegetation. Permittee shall monitor and maintain plantings to ensure the following success criteria: 80% survival of tree and shrub plantings after five years, including up to three years with supplemental water and at least two years without such assistance; and 80% cover of native species in seeded areas. Photo point stations shall be established for monitoring and the station locations must be shown on the map. Any new plantings necessary to meet the 80% establishment criterion for tree and shrub plantings shall be subject to a new five-year minimum monitoring period. CDFW will review reports and beginning with year 5 post-planting shall determine whether performance criteria have been met. Compensatory Measures. If each negotiating entity determines that there is a substantial difference in the scope of practice rights or of formal qualifications between the host jurisdictions, they may determine compensatory measures to bridge the gap. Compensatory measures should be proportionate to the substantial difference which they seek to address. Each negotiating entity should evaluate any practical professional experience obtained in the jurisdiction of origin to see whether this experience is sufficient to remedy, in whole or in part, the substantial difference in the scope of practice rights or formal qualifications between the host jurisdictions, prior to determining a compensatory measure. A compensatory measure may also take the form of, among other things, an adaptation period or, if required, an aptitude test. Once the assessment of the overall equivalency of the scopes of practice rights or qualifications of the regulated profession is completed, each negotiating entity should specify in the MRA:

Compensatory Measures. To compensate for adverse impacts to fish and wildlife resources identified above that cannot be avoided or minimized, Permittee shall implement each measure listed below. 3.1 Mitigation for permanent disturbance: Permittee proposes to restore the salt flat that is located just north of the bridge, across Sandspit Road. This is an area, owned by Southern California Gas Company, which has a small culvert which allows tidal flow into the area only during king tides. The water cannot flow back out, causing the area to trap fish and become extremely saline when the water evaporates. Mitigation will include adding a second 48-inch culvert to allow tidal water to flow into the area during normal high tides, and flow out during low tides, restoring the area back to tidal wetlands. Native plant species will be planted to provide cover and increase the value of the wetland. Salt concentrations should normalize with regular flushing. The area shall be monitored for salinity and tidal flow elevations. 3.2 Mitigation for areas of temporary disturbance: Permittee shall not impact more than the minimum required, and mitigation for temporary disturbances is included in 3.1 above.
Compensatory Measures. During this period, the Parties shall provide to each other such information as is reasonably necessary in order to enable the Parties to determine the scope and nature of the net impact, if any, of the Adverse Change Event on the Proponent.
