Compliance Enforcement. Compliance with this Environmental Covenant may be enforced pursuant to R.C. Section 5301.91 or other applicable law. Failure to timely enforce compliance with this Environmental Covenant or the use limitations contained herein by any party shall not bar subsequent enforcement by such party and shall not be deemed a waiver of the party’s right to take action to enforce any provision of this Covenant. Nothing in this Environmental Covenant shall restrict the Director of Ohio EPA from exercising any authority under applicable law in order to protect public health or safety or the environment.

Pursuant to ORC § 3746.05, if the Property or any portion thereof is put to a use that does not comply with any activity and use limitation, the covenant not to xxx issued for the Property by the Director of Ohio EPA under ORC § 3746.12 is void on and after the date of the commencement of the noncompliant use.
Compliance Enforcement. Right Coast, Inc. reserves the absolute right to remove any and all persons at its sole discretion without refund.

All costs incurred by Ohio EPA and/or any Holder other than the Owner in enforcing the terms of this Covenant against the Owner, including, without limitation, costs and expenses of suit and attorney’s fees, and any costs of environmental restoration necessitated by the Owner’s violation of the terms of this Covenant shall be borne by the Owner.

Nothing in this Environmental Covenant shall restrict the Agency, its director, or his/her successor from exercising any authority under applicable law.

Failure to timely enforce compliance with this Environmental Covenant or the use limitations contained herein by any party shall not bar subsequent enforcement by such party and shall not be deemed a waiver of the party’s right to take action to enforce any non-compliance. Nothing in this Environmental Covenant shall restrict the Secretary of DNREC from exercising any authority under applicable law.
Compliance Enforcement. Subject to approval of the Full Members, NPCC shall establish an NPCC Reliability Criteria Compliance and Enforcement Program, including matrices for measuring compliance, levying non-monetary sanctions, and developing procedures for Alternative Dispute Resolution. Such program shall be administered by the Board. The Reliability Coordinating Committee, with the full cooperation of each Member, shall expeditiously evaluate, as appropriate, alterations or measures designed to correct any assessed non-compliance and shall report such studies to the Board.
Compliance Enforcement. Tenant, at Tenant’s expense, shall comply, and shall cause its Subtenants to comply, in all material respects at all times, with the requirements of all applicable policies of insurance maintained in accordance with the provisions hereof.

7.1. On-Site Regulation. It is the responsibility of the Tribal Gaming Agency to conduct on-site gaming regulation and control in order to enforce the terms of this Gaming Compact, IGRA, and the Tribal Gaming Ordinance with respect to Gaming Operation and Facility compliance, and to protect the integrity of the Gaming Activities, the reputation of the Tribe and the Gaming Operation for honesty and fairness, and the confidence of patrons that tribal government gaming in California meets the highest standards of regulation and internal controls. To meet those responsibilities, the Tribal Gaming Agency shall adopt and enforce regulations, procedures, and practices as set forth herein.
Compliance Enforcement. The University shall continue to enforce, and all MBUs shall continue to comply with all legal regulations governing the health and safety of working conditions at the University. MBUs shall immediately report, to their manager or designated chair of the University Safety Committee, any condition that they are aware of and believe to be unsafe or in violation of standing health and safety regulations of the University. Additionally, MBUs shall report any injuries sustained or witnessed at the University in accordance with direction given by the University. Failure to observe published safety rules may lead to disciplinary action up to and including termination.
