Common use of Conditions and Exclusions Clause in Contracts

Conditions and Exclusions. Any tire, no matter how well constructed, may fail in service or otherwise become unserviceable due to conditions beyond the control of the manufacturer. Nothing in this Warranty is intended to be a representation by Xxxxxx Xxxxxxxx that tire failure cannot occur. Xxxxxx Xxxxxxxx recommends that all passenger and light truck tires (including full-size spare tires) that are beyond 10 years from their date of manufacture be replaced with new tires. Tires that are 10 or more years old should be replaced even if the tires appear to be undamaged and have not reached their tread wear limits. In some cases, a vehicle manufacturer may make a recommendation for tire replacement earlier than 10 years for their products based upon their understanding of the specific vehicle characteristics and application. If so, you should follow those vehicle manufacturer's specific recommendations for their vehicle. Bias tires tend to ride and handle differently than radials. Bias ply or bias belted and radial tires should not be mixed on the same vehicle. Xxxxxx Xxxxxxxx offers racing tires and tubes for sale. These products should be used in racing applications only. Due to the many varied and different conditions to which racing tires and tubes are exposed and because of the manner in which racing is conducted, Xxxxxx Xxxxxxxx makes absolutely no warranty, expressed or implied, as to the fitness for a general or particular purpose or of merchantability in connection with any offer of sale or sale of racing tires and tubes. “XXXXXX XXXXXXXX RACING TIRES OR TIRES USED IN RACING ARE SOLD AS IS”. Not all racing tires are designed, tested or labeled to meet the minimum safety and performance requirements of the Federal Motor Vehicle Safety Standards (FMVSS). Tires that do not meet these Federal safety standards can not be sold for use on public highways and should not be used on any public highway in any manner. Never purchase used tires! Previous usage may have damaged internal components. This damage may lead to sudden tire failure. Some states do not allow exclusion of incidental or consequential damages. As a result, this limitation or exclusion may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights that vary from state to state. When making a claim, you must return the tire to be replaced to the Xxxxxx Xxxxxxxx dealer where the tire was originally purchased for initial inspection. If the dealer which originally sold the tire is no longer available, please contact Xxxxxx Xxxxxxxx'x technical support department via email at xxxx@xxxxxxxxxxxxxxxxxxx.xxx or 0-000-000-0000 for assistance in finding a Xxxxxx Xxxxxxxx dealer (Proof of purchase will be required). Proper vehicle and tire care is necessary to obtain the expected wear and service from a tire. It is your obligation to properly maintain your tires and the vehicle upon which they are mounted, including: (A) proper fitment, (B) operating your tires at the inflation pressures recommended by the vehicle manufacturer or by your Xxxxxx Xxxxxxxx dealer, (C) keeping your tire/wheel assemblies in balance, (D) proper wheel alignment, and (E) rotation. You must check your tire’s air pressure at least monthly and before long trips. We recommend that you have your Xxxxxx Xxxxxxxx dealer inspect your tires any time you notice irregular of uneven tread wear and rotate them, if necessary. Also, they should be inspected by your dealer any time your vehicle is brought in for service. Conditions and Exclusions. Any tireCoverage under the PPP is only provided for legally registered passenger cars, no matter how well constructedvans, motorcycles, SUVs and pick-up trucks with GVW of 11,500 pounds or less. The following criteria must not be evident or else the PPP becomes null and void: • Vehicles that have been modified or used in competition, or those in agricultural use • If the vehicle has been found that the odometer has ceased, malfunctioned or shows signs of tampering • Claims resulting from collision, theft, fire, contamination of fluids, vandalism, misuse, acts of God, freezing, riot, abuse, negligence, lack of normal maintenance required by vehicle manufacturer • Pre-existing conditions and/or damage to system components prior to the service are excluded and may fail be verified through independent parts analysis by Xxxxxx’s Claims Administrator • The use of any in-house maintenance/repair facilities • In the case of a leased vehicle, the lessee must be primarily obligated for repairs and maintenance • If covered vehicle is used for towing a trailer or other vehicle or object, the PPP is not in effect unless covered vehicle is equipped with factory-installed tow package or equal • Failure to provide all necessary records will void coverage under the PPP • Failure of a covered part that is a direct result of a mechanical or structural flaw that the manufacturer acknowledges through any means, such as public recalls or factory service bulletins, or otherwise become unserviceable due to conditions beyond that the control manufacturer will repair at its expense is not covered • State tax, local tax, storage fees, shop supplies, core charges, diagnosis, and rental vehicle costs incurred during repair of the manufacturer.
