Conflict/Order of Precedence. In the event of conflict between the terms of this Agreement as executed or amended and the provisions of the Tariff, UBP and HEFPA, including, without limitation, the definitions set forth in this Agreement, this Agreement will prevail except for NATIONAL GRID’s modifications to the Tariff to reflect changes in the UBP and HEFPA. Such modifications may be implemented by NATIONAL GRID subject to the Commission’s approval.
Conflict/Order of Precedence. The Agreement and this Second Amendment are intended to be complementary such that what is set forth in one document is as binding as if set forth in each document. However, in the event of a conflict, discrepancy, error, or inconsistency that cannot be reconciled this Second Amendment shall prevail.
