1. There shall be a transitional period of 18 months prior to the operations of this Sectoral Annex.
2. The purpose of the transitional arrangement is to provide a mean whereby the Parties to this Agreement can cooperate to establish a system for designating conformity assessment bodies and can mutually build confidence in the abilities of these bodies. Successful completion of this transitional arrangement is intended to result in a determination that conformity assessment bodies comply with the applicable criteria and to have the equipment approved by the conformity assessment bodies of the exporting country accepted by the approval authority of the importing country.
3. During this transitional period, the parties shall:
(a) exchange information on technical data and conformity assessment criteria and procedures, thus developing greater familiarity with their respective regulatory requirements; and

Conformity assessment bodies. 1. For the purpose of issuing Certificates of Conformity in accordance with the provisions of this Agreement, the following shall apply:
(a) The US recognises the Notified Bodies that have been designated by the EC Member States under Directive 96/98/EC as Conformity Assessment Bodies;
(b) The EC and its Member States recognise the United States Coast Guard together with the laboratories it has accepted under 46 CFR 159.010, as a Conformity Assessment Body.
2. Each Party recognises that the Conformity Assessment Bodies of the other Party are authorised to perform the following procedures in relation to the legislative, regulatory and administrative provisions referred to in Annex I:
(a) testing and issuing of test reports,
(b) performing quality assurance functions or system certification.
3. The Regulatory Authorities of the Parties are responsible for the following procedures, but may delegate some or all of these functions to Conformity Assessment Bodies:
(a) reviewing equipment design and test results against identified standards,
(b) issuing Certificates of Conformity.
4. Prior to the entry into force of this Agreement the Parties shall exchange their respective lists of Conformity Assessment Bodies. The Parties shall inform each other promptly of any changes to their list of Conformity Assessment Bodies. The Parties shall maintain on the World Wide Web updated lists of their Conformity Assessment Bodies.
5. Each Party shall require that its Conformity Assessment Bodies record and retain details of their investigations of the competence and compliance of their sub-contractors and maintain a register of all sub-contracting. These details will be available to the other Party on request.
6. Each Party shall require that its Conformity Assessment Bodies, upon request of a Regulatory Authority of the other Party listed in Annex III, make available to the Regulatory Authorities, copies of the Certificates of Conformity and related technical documentation they have issued. CHAPTER 3 JOINT COMMITTEE
Conformity assessment bodies. The Committee established under Article 10 of this Agreement shall draw up and keep up to date, according to the procedure described in Article 11 of the Agreement, a list of the conformity assessment bodies. For the designation of conformity assessment bodies, designating authorities shall comply with the general principles contained in Annex 2 and those in Annex XI to Directive 94/9/EC.

US Authorities identified in Section IV shall designate conformity assessment bodies located in the US in accordance with the EC legislative, regulatory, and administrative provisions identified in Section I that govern designation of conformity assessment bodies, based on compliance with the appropriate EN-45000 Series Standards or the comparable ISO/IEC Guides (e. g. 22, 25, 28, 58, 61, 62, 65, etc.) Procedures for designating, listing, suspending, withdrawing, and monitoring a conformity assessment body listed in Section V shall be undertaken pursuant to Articles 7, 8, 9 and 10 of the Agreement. Conformity assessment bodies. The Parties shall inform each other of and mutually recognise the bodies responsible for the tasks described in Xxxxx XXX to Directive 2014/30/EU. Conformity assessment bodies shall provide the other bodies recognised under this chapter carrying out similar conformity assessment activities covering the same equipment with relevant information on issues relating to negative and, on request, positive conformity assessment results. The Commission, the Member States, Switzerland and the other bodies recognised under this chapter may request a copy of the type examination certi ficates and additions thereto. On request, the Commission, Member States, and Switzerland may obtain a copy of the technical documentation and the results of the examinations carried out by a body recognised under this chapter.

In accordance with the terms of Annex 1 and the Sectoral Annexes, each Party recognises that the Conformity Assessment Bodies designated by the other Party fulfil the conditions of eligibility to assess conformity in relation to their requirements as specified in the Sectoral Annexes. In designating such bodies, the Parties shall specify the scope of the conformity assessment activities for which they have been designated.
