Common use of Consequences of Recapture Clause in Contracts

Consequences of Recapture. To determine the new Base Rent under this Lease if Landlord recaptures the Subject Space, the original Base Rent under the Lease shall be multiplied by a fraction, the numerator of which is the Rentable Square Feet of the Premises retained by Tenant after Landlord’s recapture and the denominator of which is the total Rentable Square Feet of the Premises before Landlord’s recapture. The Additional Rent, to the extent that it is calculated on the basis of the Rentable Square Feet within the Premises, shall be reduced to reflect Tenant’s proportionate share based on the Rentable Square Feet of the Premises retained by Tenant after Xxxxxxxx’s recapture. This Lease as so amended shall continue thereafter in full force and effect for the remaining Premises only. Either party may require written confirmation of the amendments to this Lease necessitated by Xxxxxxxx’s recapture of the Subject Space. If Landlord recaptures the Subject Space, Landlord shall, at Xxxxxxxx’s sole expense, construct any partitions required to segregate the Subject Space from the space retained by Xxxxxx. Tenant shall, however, pay for painting, covering, or otherwise decorating the surfaces of the partitions facing the remaining Premises retained by Xxxxxx. If Landlord recaptures the Subject Space, Landlord shall pay Tenant ten percent (10%) of any Transfer Premium received by Landlord.

Consequences of Recapture. To determine the new Base Rent under this Lease if Landlord Lessor recaptures the Subject SpaceRecapture Space and Lessee does not negate Lessor’s Recapture Notice within the time periods provided therefore above, the original then current Base Rent (immediately before Lessor’s recapture) under the Lease shall be multiplied by a fraction, the numerator of which is the Rentable Square Feet square feet of the Premises Rentable Area retained by Tenant Lessee after LandlordLessor’s recapture and the denominator of which is the total Rentable Square Feet square feet of the Premises Rentable Area before LandlordLessor’s recapture. The Additional Rent, to the extent that it is calculated on the basis Rentable Area of the Rentable Square Feet within the Premises, shall be reduced to reflect TenantLessee’s proportionate share Share based on the Rentable Square Feet Areas of the Premises retained by Tenant Lessee after XxxxxxxxLessor’s recapture. This Lease as so amended shall continue thereafter in full force and effect effect, except that Lessee shall be released from liability under this Lease for future Base Rent and Additional Rent with respect to the remaining portion of the Premises onlysubject to Lessor’s Recapture Notice. Either party may require written confirmation of the amendments to this Lease necessitated by XxxxxxxxLessor’s recapture of the Subject Recapture Space. If Landlord Lessor recaptures the Subject Recapture Space, Landlord Lessor shall, at XxxxxxxxLessor’s sole expense, construct construct, paint, and furnish any partitions required to segregate the Subject Recapture Space from the space retained by Xxxxxx. Tenant shall, however, pay for painting, covering, or otherwise decorating the surfaces of the partitions facing the remaining Premises retained by Xxxxxx. If Landlord recaptures the Subject Space, Landlord shall pay Tenant ten percent (10%) Lessee as well as arrange separate metering of any Transfer Premium received by Landlordutilities.

To determine the new Base Rent under this Lease if Landlord COUNTY recaptures the Subject Space, the original Base Rent under the Lease shall be multiplied by a fraction, the numerator of which is the Rentable Square Feet of the Leased Premises retained by Tenant LESSEE after LandlordCOUNTY’s recapture and the denominator of which is the total Rentable Square Feet of the Leased Premises before LandlordCOUNTY’s recapture. The Additional Rent, to the extent that it is calculated on the basis of the Rentable Square Feet within the Leased Premises, shall be reduced to reflect TenantLESSEE’s proportionate share based on the Rentable Square Feet of the Leased Premises retained by Tenant LESSEE after XxxxxxxxCOUNTY’s recapture. This Lease as so amended shall continue thereafter in full force and effect for the remaining Leased Premises only. Either party may require written confirmation of the amendments to this Lease necessitated by XxxxxxxxCOUNTY’s recapture of the Subject Space. If Landlord COUNTY recaptures the Subject Space, Landlord COUNTY shall, at XxxxxxxxCOUNTY’s sole expense, construct any partitions required to segregate the Subject Space from the space retained by XxxxxxXXXXXX. Tenant LESSEE shall, however, pay for painting, covering, or otherwise decorating the surfaces of the partitions facing the remaining Leased Premises retained by XxxxxxXXXXXX. If Landlord COUNTY recaptures the Subject Space, Landlord COUNTY shall pay Tenant LESSEE ten percent (10%) of any Transfer Premium received by LandlordCOUNTY.

If Landlord recaptures the Subject Space, Landlord shall pay Tenant ten percent (10%) of any Transfer Premium received by Landlord.

Consequences of Recapture. To determine the new Base Rent under this Lease if Landlord recaptures any portion of the Subject SpacePremises pursuant to Section 18.5.1, the original Base Rent under the Lease shall be multiplied by a fraction, the numerator of which is the Rentable Square Feet of the Premises retained by Tenant after Landlord’s 's recapture and the denominator of which is the total Rentable Square Feet of the Premises before Landlord’s 's recapture. The Tenant's Share of Additional Rent, to the extent that it is calculated on the basis of the Rentable Square Feet within the Premises, Rent as set forth in Section 1.4(c) shall be reduced to reflect Tenant’s proportionate share based on the Rentable Square Feet of the Premises retained by Tenant after Xxxxxxxx’s Landlord's recapture in relationship to the Rentable Square Feet of the Premises before Landlord's recapture. This Lease as so amended shall continue thereafter in full force and effect for the remaining Premises only. Either party may require written confirmation of the amendments to this Lease necessitated by Xxxxxxxx’s recapture of the Subject SpaceLandlord's recapture. If Landlord recaptures a portion of the Subject SpacePremises pursuant to Section 18.5.1, Landlord shall, at Xxxxxxxx’s Landlord's sole expense, construct any partitions required to segregate the Subject Space subject space from the space retained by Xxxxxx. Tenant shall, however, pay for including painting, covering, covering or otherwise decorating the surfaces of the partitions facing the remaining Premises retained by Xxxxxx. If Landlord recaptures the Subject Space, Landlord shall pay Tenant ten percent (10%) of any Transfer Premium received by LandlordTenant.
