CONTAMINATION AND POLLUTION. Lessee, solely at Lessee’s own cost and expense, must provide clean up of the Premises, other property, or natural resources contaminated or polluted due to Lessee activities. All fines, penalties, or punitive or exemplary damages incurred by Lessee due to contaminating or polluting activities of the Lessee will be borne entirely by Lessee.
CONTAMINATION AND POLLUTION. Tenant, solely at its own cost and expense, will provide clean up of any premises, property or natural resources contaminated or polluted due to Tenant activities. Any fines, penalties, punitive or exemplary damages assigned due to contaminating or polluting activities of the Tenant will be borne entirely by the Tenant.
CONTAMINATION AND POLLUTION. The Contractor agrees to take such steps as are required:
(a) to minimise any contamination or pollution of the Site or of land or premises within the vicinity of the Site; and
(b) to prevent, in connection with the work under a Purchase Order Contract, the release by its employees, subcontractors and agents of any pollutant to the Environment. The Contractor undertakes to remove, and to bear and indemnify Essential Energy against all costs and expenses of any kind in respect of the presence or removal of pollutants, contaminants or any other waste on any premises caused or contributed to by the Contractor or any employee subcontractor or agent of the Contractor arising out of the performance of these General Conditions or a Purchase Order Contract. Such removal shall be in accordance with the requirements of codes of practice for the safe removal of such materials and any other Laws that relate to the removal of such materials.
CONTAMINATION AND POLLUTION. (i) To Chindex’s knowledge, no Hazardous Substance has been disposed of or released in, on or under the Properties nor has any Hazardous Substance migrated to or from the Properties, in each case to an extent that could result in liability for any investigation, assessment, monitoring, clean up or any other remedial action pursuant to any Environmental Law. As used herein, “Hazardous Substance” means any substance (whether in solid, liquid or gaseous form) which alone or in combination with others is capable of causing harm to human health or to the environment.

Facility User and its employees, officers, contractors, agents, and invitees shall use their best efforts to keep the premises and facilities of The Valdry Center for Philanthropy and/or SUSF’s property clean and free from any and all rubbish, contamination, and pollution, whether resulting from any overfill, discharge, spill, or other release. Facility User agrees to notify SUSF immediately if it becomes aware of the existence of the potential of any contamination or pollution on or about The Valdry Center for Philanthropy or any other SUSF facilities or property, including, but not limited to, notice of any and all overfills, spills, discharges, or other releases of petroleum products or other hazardous or toxic substances on or about The Valdry Center for Philanthropy or any property of SUSF irrespective of the cause of such release. Facility User and its employees, officers, agents, contractors, and invitees shall conform to any and all federal, state, and local laws or ordinances concerning the storage, handling, transportation, sale, or distribution of petroleum products and any and all other hazardous or toxic substances, and shall use its best efforts to cause its employees, officers, agents, contractors, and invitees to conform thereto.

All fines, penalties, or punitive or exemplary damages incurred by Xxxxxx due to contaminating or polluting activities of Lessee will be borne entirely by Xxxxxx.

It shall keep or cause the Property to be --------------------------- kept free of Hazardous Materials except to the extent that such Hazardous Materials are stored and/or used in compliance with all applicable Governmental Regulations; and, without limiting the foregoing, it shall not cause or permit the Property to be used to generate, manufacture, refine, transport, treat, store, handle, dispose of, transfer, produce, or process Hazardous Materials, except in compliance with all applicable Governmental Regulations, nor shall it cause or permit, as a result of any intentional or unintentional act or omission on the part of it, any Subsidiary or any tenant, subtenant or occupant, a release, spill, leak or emission of Hazardous Materials onto the Property or onto any other contiguous property.

Agreement without compliance with this section is void and will constitute a default. IMMEDIATE TERMINATION The County may terminate this Agreement immediately, at any time and without prior written notice, in the event Lessee violates any federal, state, or local law, rule, regulation, or lawful instruction of any Department of Airports servant or agent.

(b) to prevent, in connection with the work under a Purchase Order Contract, the release by its employees, sub-suppliers, subcontractors and agents of any pollutant to the Environment. The Supplier undertakes to remove, and to bear and indemnify Essential Energy against all costs and expenses of any kind in respect of the presence or removal of pollutants, contaminants or any other waste on any premises caused or contributed to by the Supplier or any employee, sub-supplier, subcontractor or agent of the Supplier arising out of the performance of these General Conditions or a Purchase Order Contract.
