Continuous Service Current Continuous State Employment. Total State Employment For the purposes of this Article, an employee’s years of continuous service is based on the employee’s date of hire into his or her current unbroken period of employment with any department, agency or institution of the state. This includes employment in the legislative or judicial branches. Time spent on approved unpaid leave or layoff will not be considered a break in service, but leave without pay such time will not count toward an employee’s continuous employment in determining the employee’s vacation accrual. When an employee is on leave without pay for more than eighty (80) hours in a calendar month, the employee’s vacation date will be moved forward in an amount equal to the duration of leave without pay. For the purposes of the Article, an employee’s years of current continuous state employment is based on the employee’s date of hire into their current unbroken period of employment with any department, agency, institution of higher education or a related higher education board as defined by RCW 41.06.020 and WAC 000-00-000. This includes employment in the legislative or judicial branches.   • Continuous Service The Parties shall continue providing services to each other during the pendency of any dispute resolution procedure, and the Parties shall continue to perform their obligations (including making payments in accordance with Article IV, Section 4) in accordance with this Agreement.

  • Death or Disability of Employee In the event that the Employee incurs a Termination of Service due to his or her death or Disability during a Performance Period, the Employee shall immediately vest [INSERT DESCRIPTION OF VESTING CONDITIONS]. In the event that any applicable law limits the Company’s ability to accelerate the vesting of this award of Performance Shares, this paragraph 4(b) shall be limited to the extent required to comply with applicable law.
