Contract Violation. If this contract is violated by either the school or the teacher, either has the right to demand a meeting to discuss the nature of the violation. If the school refuses to hold such a meeting, the teacher may consider this contract void. If the teacher refuses to attend such a meeting, or is unavailable to attend such a meeting, the school has the right to terminate the contract. After the meeting is held, the school may terminate this contract if the teacher is in violation of any conditions. The teacher may terminate the contract if the school is in violation of any conditions. If the school is in violation of the contract, and the teacher wishes to leave, the school must pay any and all outstanding wages and benefits, it must continue to provide accommodation, and it must provide return airfare to the teacher’s . If the teacher is in violation of the contract, the school must pay all outstanding wages and benefits, but the school is not required to pay for vacation time, and it is no longer responsible for the teacher’s accommodation or the payment of return airfare and the teacher must pay all expenses related to visas and work permit.
Contract Violation. University has the right to determine when provisions of this Contract are violated and to determine the appropriate course of action, up to and including terminating this Contract.
Contract Violation. Remedies, 10. In the event of any dispute between the parties hereto Arbitration arising under, out of, in connection with or in relation to this Agreement, said dispute shall be submitted by the parties to binding arbitration in accordance with the Rules and Procedures and under the auspices of the American Arbitration Association. The arbitration shall take place at the capital of the state of the Authorized Location of Licensee or at such other place as may be mutually agreeable to the parties. The decision of the arbitrators shall be finally, and binding on all parties. Notwithstanding the foregoing, Licensee recognizes that his "Dairy Queen" store is one of a large number of stores similarly situated and selling to the public similar products, and hence the failure on the part of a single licensee to comply with the terms of his Operating Agreement could cause irreparable damage to Licensor, American and/or to some or all other "Dairy Queen" licensees. Therefore, it is mutually agreed that in the event of a breach or threatened breach of any of the terms of this Operating Agreement by Licensee, Licensor shall forthwith be entitled to an injunction restraining such breach and/or to a decree of specific performance without having to show or prove any actual damage, together with recovery of reasonable attorney's fees and other costs incurred in obtaining said equitable relief, until such time as a final and binding determination is made by the -16-

When a teacher signs a contract with the Valley City Public School District, there is a good-faith expectation that the terms and conditions of the teaching contract will be met by the teacher and the school district. If the teacher should request from the school to be released from a signed contract, a payment of $400 would need to accompany the request if the date is after July 31, $300 if from July 1 to July 31, and $200 if from June 1 to June 30. Penalties for contract violations will be prorated according to contract load. The request is subject to the approval of the School Board with the School Board acting upon the request within five (5) working days.

Amend as follows: When a teacher signs a contract with the Valley City Public School District, there is a good-faith expectation that the terms and conditions of the teaching contract will be met by the teacher and the school district. Contract Violation. The University reserves the right to use a student’s disciplinary status (i.e., violation of University/Housing ordinances, regulations, and/or policies) and/or history of criminal activity (i.e., felonies, sex crimes, violent acts, or other similar offenses) as a factor in providing or terminating on-campus housing.

If the violating Party does not cure the violation within thirty (30) days of receipt of such notice, the other Party may cancel the Agreement without penalty.
