Contractors Personnel and Subcontractors. Compensation to Contractor for the wages and costs (including taxes, insurance, contributions, assessments and benefits) of Contractor's workers and supervisory personnel used in the performance of changed work shall be at the rates established in the Contract (if any). If the category of worker or personnel is not established in the Contract, compensation shall be based upon the actual wages and salaries and reasonable costs paid by Contractor for such worker or personnel. The Contractor shall also be entitled to a mark-up not to exceed 5% on the cost of such workers or supervisory personnel for Contractor's profit and overhead expense. All subcontracts and services provided by others for performance of changed Work requested by Owner, which have not been objected to by Owner, shall be at actual cost to Contractor of such subcontracts or services provided by others (not to exceed such subcontract price) plus a mark-up, for all profit and overhead expense of Contractor thereon which shall not exceed 5%. The cost paid by the Owner for such subcontracts and services shall not include the costs of Subguard, payment or performance bonds, or other types of performance guarantees. The mark-up for all profit and overhead expenses of any Subcontractor for the performance of changed Work shall not exceed 5% of the Subcontractor’s actual cost for such changed Work.
