CONTRACTOR’S RESPONSIBILITY FOR PROJECT SAFETY. 2.14.1 Contractor recognizes the importance of performing its work in the safest manner possible so as to prevent damage, injury or loss to (a) all individuals at or in the vicinity of the Work, whether working or visiting the Project or Campus; (b) all work, including materials and equipment incorporated or stored on- or off-Site; and (c) all property adjacent to the Site. On that basis Contractor assumes responsibility for implementing and monitoring all safety precautions and programs related to the performance of the Work and will submit a Safety Plan complete form to Owner and Design Professional at the time of issuance of the Notice to Proceed with the Work, upon Owner request. Contractor shall, prior to commencing construction, designate a safety manager with the necessary qualifications and experience to supervise the implementation of the plan and the monitoring of all safety precautions and programs related to the Work. The safety manager shall make routine daily inspections of the Work Site, and shall hold at least weekly safety meetings with Contractor’s personnel and Subcontractors.

CONTRACTOR’S RESPONSIBILITY FOR PROJECT SAFETY. The CONTRACTOR acknowledges the importance of performing the work on the Project in a safe manner so as to prevent damage, injury or loss to all individuals at the work site and the area near the work site. The CONTRACTOR assumes responsibility for implementing and monitoring all safety precautions and programs related to the performance of the work site. The CONTRACTOR shall make routine daily inspections of the work site and shall hold regular safety meetings with subcontractors. The CONTRACTOR shall immediately report in writing any safety-related injury, loss, damage or accident arising from the work to the CITY’s representative and, to the extent mandated by law, to all government or quasi-government authorities having jurisdiction over safety related matters involving the Project or the work site. The CONTRACTOR’s responsibility for safety under this Section is not intended in any way to relieve the Construction Company or its suppliers and subcontractors of their own contractual and legal obligations and responsibility for complying with all laws and regulations related to health and safety matters and taking all necessary measures to implement and monitor all safety precautions and programs to guard against injuries, losses, damages, or accidents resulting from their performance at the work site.

  • CONTRACTOR'S RESPONSIBILITY Nothing herein shall be construed as limiting in any way the extent to which contractor/renter may be held responsible for damages resulting from contractor/renter’s operations, acts, omissions or negligence. Insurance coverage obtained in the minimum amounts specified above shall not relieve contractor/renter of liability in excess of such minimum coverage, nor shall it preclude the fair from taking other actions available to it under contract documents or by law, including, but not limited to, actions pursuant to contractor/renter’s indemnity obligations. The contractor/renter indemnity obligations shall survive the expiration, termination or assignment of this contract.
