Common use of Copyrights and Patents Clause in Contracts

Copyrights and Patents. All tangible and intangible personal property created by the PROVIDER under a non-unit component of this Provider Agreement shall become the property of the State of New Mexico and shall be delivered by the PROVIDER to the DEPARTMENT no later than the termination date or expiration of the term of this Provider Agreement and shall not be the subject of an application for a copyright or a patent by or on behalf of the PROVIDER. Nothing in this Article shall prevent the sale of goods produced by the clients of a PROVIDER funded under this Provider Agreement.
