Common use of Court Leave Clause in Contracts

Court Leave. With the exception of an employee under suspension or on leave of absence without pay, leave of absence with pay will be given to every employee who is required: (a) to be available for jury selection; (b) to serve on a jury; or (c) by subpoena or summons to attend as a witness in any proceeding held (i) in or under the authority of a court of justice or before a grand jury of Canada; (ii) before a court, judge, justice, magistrate or coroner of Canada; (iii) before the Senate or House of Commons of Canada or a committee of the Senate or House of Commons otherwise than in the performance of the duties of his/her position; (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by Canadian law to compel the attendance of witnesses before it; or (v) before an arbitrator or umpire or a person or body of persons authorized by Canadian law to make an inquiry and to compel the attendance of witnesses before it.

Court Leave. With the exception 35.4.1 Leave of absence with pay shall be given to every employee, other than an employee under suspension or on leave of absence without pay, leave of absence with pay will be given to every employee or under suspension, who is required: (a) 35.4.1.1 to be available for jury selection;; or (b) 35.4.1.2 to serve on a jury; or (c) 35.4.1.3 by subpoena or summons to attend as a witness in any proceeding held (ia) in or under the authority of a court of justice or before a grand jury of Canada; (iib) before a court, judge, justice, magistrate or coroner of Canada; (iiic) before the Senate or House of Commons of Canada or a committee of the Senate or House of Commons otherwise than in the performance of the duties of his/her his position; (ivd) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by Canadian law to compel the attendance of witnesses before it; or (ve) before an arbitrator or umpire or a person or body of persons authorized by Canadian law to make an inquiry and to compel the attendance of witnesses before it.

With the exception of an employee under suspension or on leave of absence without pay, leave of absence 48.01 Leave with pay will shall be given to every employee, other than an employee already on leave without pay, on education leave or under suspension who is required: (a) to be available for jury selection; (b) to serve on a jury; or; (c) by subpoena or summons or other legal instrument to attend as a witness in any proceeding to which the employee is not a party held: (i) in or under the authority of a court of justice or before a grand jury of Canada;jury, (ii) before a court, judge, justice, magistrate or coroner of Canada;coroner, (iii) before the Senate or House of Commons of Canada or a committee of the Senate or House of Commons otherwise than in the performance of the duties of his/her the employee’s position;, (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by Canadian law to compel the attendance of witnesses before it; or, (v) before an arbitrator or umpire or a person or body of persons authorized by Canadian law to make an inquiry and to compel the attendance of witnesses before it.
