Common use of Court Leave Clause in Contracts

Court Leave. The Employer shall grant leave with pay to an employee, other than an employee on leave of absence without pay or under suspension who is required: (a) to be available for jury selection; (b) to serve on a jury; or (c) by subpoena or summons to attend as a witness in any proceeding held: (i) in or under the authority of a court of Justice or before a Grand Jury, (ii) before a court, judge, justice magistrate or coroner, (iii) before the Senate or House of Commons of Canada or a Committee of the Senate or House of Commons otherwise than in the performance of the duties of his or her position, (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it, or (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it.

Court Leave. 48.01 The Employer shall grant leave with pay to an employee, other than an employee on leave for the period of absence without pay time he or under suspension who she is requiredcompelled: (a) to be available for jury selection; (b) to serve on a jury; or; (c) by subpoena or summons or other legal instrument to attend as a witness in any proceeding held: (i) in or under the authority of a court of Justice justice or before a Grand Jurygrand jury, (ii) before a court, judge, justice magistrate justice, magistrate, or coroner, (iii) before the Senate or House of Commons of Canada or a Committee committee of the Senate or House of Commons otherwise than in the performance of the duties of his or her the employee’s position, (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it, or (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it.

Court Leave. The Employer shall grant leave with pay to an employee, other than an employee on leave for the period of absence without pay or under suspension who time he/she is required: (, a) to be available for jury selection; (; b) to serve on a jury; or (c) by subpoena or summons to attend as a witness in any proceeding proceeding, except one to which an employee is a party, held: : (i) in or under the authority of a court of Justice justice or before a Grand Jury, grand jury; (ii) before a court, judge, justice justice, magistrate or coroner, ; (iii) before the Senate or House of Commons of Canada or a Committee committee of the Senate or House of Commons otherwise than in the performance of the duties of his or his/her position, ; (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it, or ; or (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before itwitnesses. d) Notwithstanding clause 19.14c) where the employee’s involvement in the proceedings as a witness arises out of his/her employment outside the Library of Parliament, leave without pay shall be granted.

The Employer shall grant leave with pay to an employee, other than an employee on leave for the period of absence without pay or under suspension who time he/she is required:, (a) to be available for jury selection; (b) to serve on a jury; or; (c) by subpoena or summons to attend as a witness in any proceeding proceeding, except one to which an employee is a party, held: (i) in or under the authority of a court of Justice justice or before a Grand Jury,grand jury; (ii) before a court, judge, justice justice, magistrate or coroner,; (iii) before the Senate or House of Commons of Canada or a Committee committee of the Senate or House of Commons otherwise than in the performance of the duties of his or his/her position,; (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it, or; (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before itwitnesses. d) Notwithstanding clause 19.14c) where the employee’s involvement in the proceedings as a witness arises out of his/her employment outside the Office of the Parliamentary Budget Officer, leave without pay shall be granted.

Court Leave. The Employer shall grant leave (A) Leave of absence with pay shall be given to an every employee, other than an employee on leave of absence without pay pay, or under suspension suspension, who is required: (a1) to be available for jury selection;; or (b2) to serve on a jury; or (c3) by subpoena or summons to attend as a witness in any proceeding held: (ia) in or under the authority of a court of Justice justice or before a Grand Jury,grand jury of Canada; (iib) before a court, judge, justice justice, magistrate or coroner,coroner of Canada; (iiic) before the Senate or House of Commons of Canada or a Committee committee of the Senate or House of Commons otherwise than in the performance of the duties of his or her position,; (ivd) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by Canadian law to compel the attendance of witnesses before it, ; or (ve) before an arbitrator or umpire or a person or body of persons authorized by Canadian law to make an inquiry and to compel the attendance of witnesses before it.

Court Leave. (d) Notwithstanding clause 20.12

Court Leave. The Employer shall grant leave with pay to an employee, other than With the exception of an employee under suspension or on leave of absence without pay, leave of absence with pay or under suspension will be given to every employee who is required: (a) to be available for jury selection; (b) to serve on a jury; or (cb) by subpoena or summons to attend as a witness in any proceeding held: (i) in or under the authority of a court of Justice justice or before a Grand Jury,grand jury of Canada; (ii) before a court, judge, justice justice, magistrate or coroner,coroner of Canada; (iii) before the Senate or House of Commons of Canada or a Committee committee of the Senate or House of Commons otherwise than in the performance of the duties of his or his/her position,; (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by Canadian law to compel the attendance of witnesses before it, ; or (v) before an arbitrator or umpire or a person or body of persons authorized by Canadian law to make an inquiry and to compel the attendance of witnesses before it.

Court Leave. The Employer shall grant leave with pay to an employee, other than an employee on leave for the period of absence without pay or under suspension who time he/she is required:, (a) to To be available for jury selection;. Court Leave. The Employer shall grant leave Leave of absence with pay shall be given to an every employee, other than an employee on leave of absence without pay pay, or under suspension suspension, who is required: (a) to be available for jury selection; (b) to serve on a jury; or (cb) by subpoena or summons to attend as a witness in any proceedings, except for a proceeding in which the employee is a party, held:: ** (i) in or under the authority of a court of Justice or before a Grand Jury,justice; (ii) before a court, judge, justice justice, magistrate or coroner,; (iii) before the Senate or House of Commons of Canada Canada, or a Committee committee of the Senate or House of Commons Commons, otherwise than in the performance of the duties of his or her position,; (iv) before a legislative council, legislative assembly or house of assembly, or any committee thereof that is authorized by law to compel the attendance of witnesses before it, ; or (v) before an arbitrator or umpire or a person or body of persons authorized by law to make an inquiry and to compel the attendance of witnesses before it; or (c) to appear on his or her own behalf before an Adjudicator appointed by the Public Service Labour Relations Board and the employee’s grievance is upheld.

Court Leave. The Employer shall grant leave with pay to an employee, other than an employee on leave for the period of absence without pay or under suspension who time he/she is required:, (a) to To be available for jury selection;. (b) to To serve on a jury; or. (d) Notwithstanding clause 20.12
