Common use of Court Leave Clause in Contracts

Court Leave. Leave of absence without loss of regular pay shall be given to a Nurse other than a Nurse on leave of absence without pay or under suspension, who is required: (a) to serve on a jury (including the time spent in the jury selection process); or (b) by subpoena or summons to attend as a witness in any proceedings for an employment related matter held: (i) in or under the authority of a court or tribunal; or (ii) before an Arbitrator or person or persons authorized by law to make an inquiry to compel the attendance of witnesses before it. The provisions of (a) and (b) are not applicable to a Casual Nurse (except a Casual Nurse while in a Temporary Position). (c) by the Employer to appear as a witness in a legal proceeding, in which case the time involved shall be considered time worked. This provision (c) is applicable to a Casual Nurse provided the Casual Nurse is appearing as a witness for the Employer. (d) The leave of absence shall be sufficient in duration to permit the Nurse to fulfill the witness or jury obligation. (e) A Nurse given Court leave of absence without loss of regular pay shall pay to the Employer the amount that the Nurse receives for this duty. This provision is not applicable to a Casual Nurse (except a Casual Nurse while in a Temporary Position) other than as specified in Article 9.06 (c)).
