2.1 This agreement shall apply to:

2.4 Excludes
(a) Trainees as defined by the FW Act; and
(b) work by employees in early intervention services; and
(c) work by employees engaged to support clients with psychosocial disabilities arising from mental illness, where the support is solely or predominately focused on

4.1 This Agreement is intended to cover:

This Agreement will be reviewed and renegotiated during the final three (3) months of its life. CLAUSE 5 : RELATIONSHIP TO PARENT AWARD 5.1 This Agreement is a comprehensive document that governs all of the terms and conditions of employment to the exclusion of the Local Government Employees Award, to the extent permitted by the Fair Work Act 1994.

(a) Xxxxx Street; and,
(b) Employees of Xxxxx Street who are covered by the classifications of this Agreement; and
(c) Any other party noted as being covered by the Agreement in the decision of the Fair Work Commission to approve the Agreement.

4.1.1 Subject to clause 4.1.2, this Agreement covers:
a. the ABC;
b. the Community and Public Sector Union (subject to the CPSU meeting the requirements to be a party under the Act); and
a. the Media Entertainment and Arts Alliance (subject to MEAA meeting the requirements to be a party under the Act); and
b. all employees of the ABC (other than those described in clause 4.1.2 below), in respect of work done by employees of the ABC (other than those described in clause 4.1.2 below).
4.1.2 This Agreement does not cover:
a. employees covered by the relevant ABC Retail Agreement;
b. employees covered by the Actors Stream of the Australian Broadcasting Corporation Enterprise Award 2016 or relevant ABC Actors Agreement; and
c. employees classified as Executives and Directors.
Coverage and Parties. 1.1 The parties to this agreement are St Xxxx of God Hauora Trust, Health and Ability Services (hereinafter referred to as “the employer”); and New Zealand Nurses Organisation (hereinafter referred to as "the union”).
1.2 The operation of the employer’s facilities constitutes an “essential service” in terms of the Employment Relations Xxx 0000.
1.3 This agreement wholly replaces any express or implied contractual terms or provisions (including those implied by custom and practice) that may have existed and bound the parties at the date of this agreement coming into force. Apart from any statutory obligations, the employer is not bound by any undertakings or provisions (either express or implied), contained within or arising from any current or previously existing Act, Regulation, Award, agreement, contract, instrument, or undertaking between the parties to this present contract or their agents.
1.4 The employer will comply with the provisions of the Employment Relations Xxx 0000 with regard to the passing on to non-union members of the terms and conditions of this collective agreement.
1.5 This agreement covers only employees who are:
1.5.1 Financial members of the union; and
1.5.2 Hold positions as classified in Schedule 2.
1.6 The employer agrees not to pass on automatically to non-union members terms or conditions that are the same or substantially the same as those contained in this collective agreement. This means that the employer and non-union members shall individually negotiate their terms and conditions of employment.

4.1 This Agreement is intended to cover:
4.1.1 Employees in Human Resources Adviser roles whose employment conditions at the date of commencement of this Agreement are contained in employment contracts with Country Energy and whose Total Remuneration Package (TRP) is within the Hay evaluated salary range for the Human Resources Adviser role, as set out below: HR Adviser Minimum Threshold Salary Level (entry) - $91,320.00 TRP Maximum Threshold Salary Level - $116,620.00 TRP
4.1.2 Country Energy undertakes to ensure that as a result of this new enterprise bargaining agreement, no employee will suffer any detrimental effect to their benefits and/or conditions as set out by their previous employment conditions prescribed by the Manager’s and Specialist’s Enterprise Bargaining Agreement.
4.1.3 Any disputes in relation to the application of this agreement shall be mediated through the Grievance Resolution Procedure as prescribed by the Country Energy Enterprise Award, 2007, and successor instruments.
