Credit Reports; Search Reports. Lender shall have received, in form and substance satisfactory to Lender, the results of UCC searches with respect to Borrower and the Guarantor, and lien, litigation, judgment and bankruptcy searches for Borrower and Guarantor, conducted in such jurisdictions and for such other entities as Lender deems appropriate in order to verify, among other things, that (i) Lender has a first priority perfected lien on and security interest in all of the Collateral, (ii) there are no judgments, tax liens or bankruptcy filings affecting the Borrower, the Guarantor or the Timeshare Project, and (iii) there is no material litigation outstanding affecting Borrower or the Guarantor (other than as disclosed in the public filings relating to Guarantor and made with the United States Securities and Exchange Commission or as otherwise disclosed to Lender in writing).

Lender shall have received, in form and substance satisfactory to Lender, the results of current UCC searches (or its equivalent under Mexican law) with respect to Borrower and the Required Guarantors and current lien, litigation, judgment and bankruptcy searches (or its equivalent under Mexican law) for Borrower, any and all Required Guarantors conducted in such jurisdictions as Lender deems appropriate. In addition, a member of Lender's credit department shall have visited each Time-Share Project and shall be satisfied with the results of such inspection.

  • Credit Reports With your consent, in dealing with you we may obtain and consult credit reports on you prepared by credit reporting agencies. You have rights of access and correction in relation to the files held on you by these agencies by contacting them.
