Criminal Complaint. Violation of the residency provisions of this By-law may be enforced by criminal complaint filed by any police officer of the Town of Xxxxxxxxx. Each day a violation exists shall constitute a separate violation. The fine for each violation, upon conviction, shall be $300. In addition to enforcement by criminal complaint, violation of the residency provisions of this By-law may be enforced through any lawful means in law or in equity by any police officer of the Town of Xxxxxxxxx. Also, any police officer of the Town of Xxxxxxxxx may give written notification to the property owner, if other than the offender, the offender’s landlord, parole officer and/or probation officer and the Commonwealth's Sex Offender Registry Board that the sex offender has violated this By-Law. Additionally, any other penalties may apply as the law permits.

Criminal Complaint. Whenever, an employee is accused of committing a xxxxx- nal act, whether on duty or off duty, he/she will notify their Unit, Section, Shift Lieuten- ant/Supervisor who will immediately notify a member of the Professional Standards Unit and the appropriate Division Commander, who will notify the Chief of Police through the chain of command. {52.1.3, 52.2.2} An employee who may have been involved as either a participant or witness to the alleged in- cident being investigated will submit, upon request, a written report concerning his/her actions and observations to the Professional Standards Unit. After reviewing the results of the completed investigation, the Professional Standards Unit will indicate, in writing, recommendation(s). The investigative reports, with recommendation(s), will be forwarded to the ASD Commander forthwith. The file must contain the following:
Criminal Complaint. On 13 October 2016 XX filed a criminal complaint with the Investigating Magistrate at the Dutch speaking Court of First Instance of Brussels against KBC Bank. On 9 April 2019 LK filed an additional complaint with the same Investigation Magistrate against KBC Bank and certain of its (former) employees. The criminal complaints are based, inter alia, on: embezzlement, theft and money-laundering. On 29 September 2021, KBC Bank received notification that the xxxxxxxx section of the Criminal Court of Brussels will decide on the closure of the criminal investigation and on the regulation of procedure (either dismissal of charges or referral to the criminal court). On 16 November 2021 the xxxxxxxx section of the Criminal Court decided to postpone indefinitely the proceedings because of LKI and LKB’s request for additional investigation. On 16 December 2021, the Investigating Magistrate denied the request, except for one investigative measure. LKI / LKB appealed this decision. On 22 February 2024, the chamber for indictments rejected the LKI / LKB appeal against the decision of the investigation magistrate of 16 December 2021. On 20 August 2024, pleadings were before the xxxxxxxx section of the Criminal Court of Brussels on the closure of the criminal investigation and dismissal/referral to the Criminal Court of Brussels. On 17 September 2024, the xxxxxxxx section decided to postpone indefinitely the proceedings because certain electronic documents in the criminal file could not be accessed.

  • Criminal Convictions Grantee certifies that neither it nor any officer, director, partner or other managerial agent of Grantee has been convicted of a felony under the Xxxxxxxx-Xxxxx Act of 2002, nor a Class 3 or Class 2 felony under Illinois Securities Law of 1953, or that at least five (5) years have passed since the date of the conviction.   • Criminal Claims Notwithstanding any provision of this Article XII to the contrary, in the event that any Person being indemnified under this Article XII shall become involved in any criminal action, suit or proceeding, whether judicial, administrative or investigative, the Receiver shall have no obligation hereunder to indemnify such Person for liability with respect to any criminal act or to the extent any costs or expenses are attributable to the defense against the allegation of any criminal act, unless (i) the Person is successful on the merits or otherwise in the defense against any such action, suit or proceeding, or (ii) such action, suit or proceeding is terminated without the imposition of liability on such Person.

  • Complaints Process The School shall establish and adhere to a process for resolving public complaints which shall include an opportunity for complainants to be heard. The final administrative appeal shall be heard by the School's Governing Board, except where the complaint pertains to a possible violation of any law or term under this Contract. The complaints process shall be readily accessible from the School’s website, as described in Section 11.4.1.

  • Criminal History Applicants who have criminal convictions may be denied. Any crimes associated with drugs, violence, sex, property damage, and/or weapons may be grounds for automatic disqualification. Eligibility is dependent upon the level, disposition, and time since the crime occurred. Open cases for similar crimes may be grounds for denial. Credit. A credit check will be performed, and the following may be grounds for denial: past due or dishonored debt, the absence of a credit history, unpaid housing accounts, unpaid utility accounts.

  • Grievance Investigation The Employer agrees to supply to the Union the names of all applicants for a vacancy, or new position in the course of a grievance investigation.

  • Indictment The indictment or institution of any legal process or proceeding against, any Loan Party or any Subsidiary thereof, under any federal, state, municipal, and other criminal statute, rule, regulation, order, or other requirement having the force of law for a felony; or
