Common use of CRIMINAL OR LEGAL LIABILITY Clause in Contracts

CRIMINAL OR LEGAL LIABILITY. Where no language exists in an Agreement the following shall apply: The Employer shall defend, negotiate or settle civil and/or criminal claims, suits or prosecutions arising out of acts performed by an employee in the course of his/her duties, provided that the Employer is satisfied that the employee performed duties required by the Employer, and/or the employee acted within the scope of his/her employment.
