Criminal Records Bureau. 6.6.1 Where specified by the Authority the Supplier shall procure that in respect of all potential Staff or persons supplying any of the Services (each a “Named Employee”) before a Named Employee enters the Premises:-
(a) each Named Employee is questioned as to whether he or she has any convictions; and where appropriate to the Services being provided
(b) the results are obtained of a check of the most extensive available kind made with the Criminal Records Bureau in accordance with Part V of the Police Xxx 0000 in respect of each Named Employee. The check for each Named Employee shall include:-
(i) a search of the list held pursuant to the Protection of Children Xxx 0000 where the supply of the Services may involve contact with children; and/or
(ii) a search of the list held pursuant to Part VII of the Care Standards Xxx 0000 where the supply of Services may involve contact with vulnerable adults (as defined in that Act).
(c) a copy of the results of such check are notified to the Authority.
6.6.2 The Supplier shall procure that no person who discloses any convictions, or who is found to have any convictions following the results of a Criminal Records Bureau check, is employed or engaged by the Supplier or on the Supplier’s behalf without the Authority’s prior written consent (such consent not to be unreasonably withheld or delayed).
6.6.3 The Supplier shall procure that the Authority is notified of any member of Staff who, subsequent to his/her commencement of employment as a member of Staff, receives a conviction or whose previous convictions become known to the Supplier (or any employee of a sub-contractor involved in the supply of the Services). The Parties agree that where such notification is made it shall be reasonable for the Authority to withhold access to the Premises from the member of Staff concerned, pursuant to Clause 3.3 (Supplier’s Staff).

Criminal Records Bureau. 30.1 Where specified by the CLIENT the SERVICE PROVIDER shall procure that in respect of all potential Staff or persons supplying any of the Services (each a “Named Employee”) before a Named Employee enters the Premises:-
30.1.1 each Named Employee is questioned as to whether he or she has any convictions; and where appropriate to the Services being provided
30.1.2 the results are obtained of a check of the most extensive available kind made with the Criminal Records Bureau in accordance with Part V of the Police Act 1997 in respect of each Named Employee. The check for each Named Employee shall include:-
(i) a search of the list held pursuant to the Protection of Children Act 1999 where the supply of the Services may involve contact with children; and/or
(ii) a search of the list held pursuant to Part VII of the Care Standards Act 2000 where the supply of Services may involve contact with vulnerable adults (as defined in that Act).
30.1.3 a copy of the results of such check are notified to the CLIENT.
30.2 The SERVICE PROVIDER shall procure that no person who discloses any convictions, or who is found to have any convictions following the results of a Criminal Records Bureau check, is employed or engaged by the SERVICE PROVIDER or on the SERVICE PROVIDER’S behalf without the CLIENT’S prior written consent (such consent not to be unreasonably withheld or delayed).
30.3 The SERVICE PROVIDER shall procure that the CLIENT is notified of any member of Staff who, subsequent to his/her commencement of employment as a member of Staff, receives a conviction or whose previous convictions become known to the SERVICE PROVIDER (or any employee of a sub-contractor involved in the supply of the Services). The Parties agree that where such notification is made it shall be reasonable for the CLIENT to withhold access to the Premises from the member of Staff concerned, pursuant to Clause 16 (SERVICE PROVIDER’S Staff).
Criminal Records Bureau. 19.1 The Contractor shall not engage persons in the provision of the Services that have convictions or cautions that would render them unsuitable to carry out the duties provided for in this contract.
19.2 The Contractor shall comply with the requirements of the DTV Probation Trust’s Vetting Policy 29th September 2010 in relation to the provision of the services.
19.3 The Contractor shall be required to maintain current, accurate and adequate records of all persons who are to be engaged in providing the Service for a period of 5 years from the termination of the contract.
19.4 The Contractor shall upon reasonable request by the Trust’s appropriate officer provide to that officer in good faith, details including full name, address, date of birth and place of birth of any employee or operative whether directly employed by the Contractor or otherwise engaged by them to perform the contract or any part of the service contract provision and shall do so within 14 days of any such request for the purpose of enabling the Trust to carry out a criminal records check pursuant to the provisions of Part V of the Police Xxx 0000.
19.5 Where, following a check under clause 19.4 above, a criminal conviction certificate is obtained by the Trust following either a standard or enhanced criminal records bureau check and the nature of the listed previous convictions leads the Trust to the reasonable conclusion that the person who was checked is unsuitable to perform the service specified in the contract, then upon the Trust giving notice to the Contractor, they shall upon receipt of that notice remove the person considered as unsuitable from the contract service or where the person has not at that time started to perform the contract service the Contractor shall act so as to stop that person from performing the service. The Trust is not under any obligation to disclose the results of any criminal records bureau check.
Criminal Records Bureau. These provisions enable the Employer and Authority to have a right of veto over any employees of the Contractor who generate unsatisfactory results from criminal records checks.
Criminal Records Bureau. Additional clause 29 29.23 The Contractor procures that, in respect of all potential staff or persons performing any part of the service (each an “Identified Employee”), before an Identified Employee attends any site or premises at which the service is to be performed: 29.23.1 each Identified Employee is questioned as to whether he or she has any convictions; and 29.
Criminal Records Bureau. The Suppler shall ensure that in respect of any its servants employees agents or subcontractors whom in performing Services for the Authority under this Contract may come into contact with children or vulnerable adults:
24.1 Wherever possible prior to such a person commencing the performance of the Services, the Supplier shall undertake a check of the person’s previous convictions and criminal records history of the most extensive available kind made with the Criminal Records Bureau (‘CRB’) provided always that:
24.1. 1The Authority shall provide reasonable assistance where necessary to secure the obtaining of such CRB checks where the Supplier is unable to obtain such checks. The Supplier shall reimburse the Authority’s reasonable costs in providing such assistance;
Criminal Records Bureau. 36.1 The Contractor shall procure that, in respect of all persons who the Contractor proposes to use in the performance of any of the Services, before the person begins to perform any of the Services:
(a) each person is questioned as to whether he or she has any convictions; and
(b) the results are obtained of a check of the most extensive available kind made with the Criminal Records Bureau in accordance with Part V of the Police Act 1997 in respect of each person. The check for each person shall include:
(i) a search of the list held pursuant to the Protection of Children Act 1999 where the performance of the Services may involve contact with children; and
(ii) a search of the list held pursuant to Part VII of the Care Standards Act 2000 where the performance of the Services may involve contact with vulnerable adults (as defined in the Care Standards Act 2000); and
(c) a copy of the results of such check are notified to the Authority.
36.2 The Contractor shall procure that no person who discloses any convictions (including spent convictions), or who is found to have any convictions (including spent convictions) following the results of a Criminal Records Bureau check, is used employed or engaged by the Contractor in relation to the Services without the Authority’s prior written consent.
36.3 The Contractor shall procure that the Authority is notified of any person who, subsequent to his/her engagement in relation to the Services, receives a conviction or whose previous convictions become known to the Contractor.
