Damage by Errant Golf Balls. Each owner of any portion of the Grantor’s Property, for itself and each and every subsequent owner, by through, or under such owner, hereby acknowledges and agrees that the existence of a golf course on the Golf Course Property is beneficial and highly desirable, and that portions of the Grantor’s Property adjacent to the golf course are subject to the risk of damage or injury due to errant golf balls. Each such owner, for itself and each and every subsequent owner, by through, or under such owner, along with its servants, independent contractors, agents, members, guests and invitees hereby assume the risk of damage and injury and hereby releases the Grantee, as owner of golf course, its lessees, operators, successors and assigns from any and all liability or damage or injury caused by errant golf balls in, on or around the Grantor’s Property arising from, directly or indirectly, golf balls flying, landing, hitting or resting in or around the Grantor’s Property.
