Data Processing Agreement. The Data Processing Agreement, including the Approved Data Transfer Mechanisms (as defined in the Data Processing Agreement) that apply to your use of the Services and transfer of Personal Data, is incorporated into this Agreement by this reference. Each party will comply with the terms of the Data Processing Agreement and will train its employees on DP Law.

For the purposes of the Standard Contractual Clauses, Institution and its applicable Affiliates, as defined by the DPA, are each the data exporter, and Institution’s acceptance of this Agreement shall be treated as its execution of the Standard Contractual Clauses and Appendices.
Data Processing Agreement. 1.10.1 If the Service Provider processes any personal data on the Purchaser’s behalf and in accordance with its instructions as part of or in connection with the performance of the Services, the Parties agree that the Data Processing Agreement set forth in Appendix 5 shall be finalized and apply between the Parties, and shall be deemed an integrated part of these Individual Terms.
1.10.2 The Parties shall at all times comply with applicable laws on data protection and privacy, in particular, but not limited to the EU Data Protection Laws (as defined in Appendix 2), and shall use its commercially reasonable efforts to ensure that any Affiliates or subcontractors engaged by it also comply therewith.
Data Processing Agreement. As required by law or as otherwise agreed by the parties, data protection measures may be described in more detail in a data processing agreement separately entered into by the parties, which will be made supplementary to these BEP Terms (“Data Processing Agreement”). In the event of any conflict between these BEP Terms and the Data Processing Agreement, the Data Processing Agreement shall prevail, except as expressly provided in this Section 2.3. As regards any Data Processing Agreement made effective prior to 17 February 2020, Sections 5.2 and 5.3 of the Data Processing Agreement are hereby deleted in their entirety and replaced with the following:
