Data Transmission Notification. Customer’s use of the Software and/or electronic filing may transmit to CCH’s servers various information relating to how Customer and its Authorized Users use the Software and/or the electronic filing services, as well as general information about Customer’s and its Authorized Users’ computer system from which CCH’s servers are being accessed (for example, system configuration, type of internet connectivity, RAM, CPU, operating system, browser version), as well as certain records that Customer has created while using the Software, including those that Customer did not otherwise transmit to the IRS. CCH may use this information for purposes of improving, enhancing or further developing the Software and/or the electronic filing services, for internal quality assurance and software error checking, to assist users with multiple offices and as otherwise necessary or appropriate to perform its obligations pursuant to this Agreement. CCH shall keep this information confidential in accordance with Article 10 hereof.

The Licensed Program may transmit to the servers on which the Licensed Program is hosted, various information relating to how Licensee and its authorized users access and/or use the Licensed Program, as well as general information about Licensee’s and his/her/its authorized users’ computer system from which the Licensed Program is being accessed (for example, system configuration, type of internet connectivity, RAM, CPU, operating system, browser version), as well as certain records that Licensee has created while using the Licensed Program, including those that Licensee did not otherwise transmit to the IRS. Licensor may use this information for purposes of improving, enhancing or further developing the Licensed Program, for internal quality assurance and software error checking, to assist users with multiple offices and as otherwise necessary or appropriate to perform its obligations pursuant to this Agreement. Licensor shall keep this information confidential in accordance with confidentiality obligations set forth hereunder.

Publisher may use this information for purposes of improving, enhancing or further developing the Software, for internal quality assurance and software error checking, to assist users with multiple offices and as otherwise necessary or appropriate to perform its obligations pursuant to this Agreement. Publisher shall keep this information confidential in accordance with Section 10 hereof.

Certain Products may transmit to the servers on which such Products are hosted, various information relating to how Customer and Authorized Users access and/or use such Products, including, but not limited to Statistical Data, as well as certain records that Customer has created while using the Products, including those that Customer did not otherwise transmit to the IRS. CCH SFS may use this information for purposes of improving, enhancing or further developing the Products, for internal quality assurance and software error checking, to assist users with multiple offices and as otherwise necessary or appropriate (as deemed in CCH SFS’s sole discretion) to perform its obligations pursuant to this Agreement

End User Subscription Terms (Comm Form 111720) Exhibit A Data Feed Terms The provisions of this Exhibit A shall apply to any and all content, data, and other information that Customer accesses through the Application as part of a Data Feed.

Master 09/2012 Schedule A Application Support Severity Definitions Support requests for all Supported Applications may be submitted by Customer online through CCH’s web-based customer support system, email, chat, or by telephone if confirmed in writing to CCH within 24 hours of such request by telephone. The support request severity level is determined jointly by Customer and CCH and is based on the following severity definitions: Severity Level Characteristics Response Target Recovery / Solution Target 1 Application is functionally inoperative. Impact to operations is so severe that immediate resolution and the highest speed of response is required. When a Severity 1 call is received and verified, a response team will be assembled at CCH to address and resolve the outstanding issue. The response team will consist of sufficiently senior support and development team members.
