The Date Compliance clause establishes requirements for parties to adhere to specified dates or deadlines outlined in the agreement. Date Compliance. If applicable to this contract, the Contractor is responsible for ensuring that all materials and equipment installed as part of this contract shall accurately process date/time data between year calculations, to the extent that other information technology, used in combination with the information technology being acquired, properly exchanges date/time data with it.
Date Compliance. All data and data sensitive systems of the Company are fully Date Compliant. "Date Compliant" shall mean (a) that such data and data sensitive systems are able to manage and manipulate data involving dates, including, but not limited to, single-century formulas and multi-century formulas, date data century recognition and calculations that accommodate same century and multi-century formulas, comparing and sequencing, and leap year calculations; (b) that a subsequent abnormally ending scenario within the data and data sensitive systems or the generation of incorrect values involving such dates will not occur; and (c) that all date-related user interface functionalities, data fields, continuing date values, date data interface values and date-related functions will provide valid and unambiguous results.
Date Compliance. Highpoint Technology Group warrants that none of the computer hardware and software systems and equipment incorporated into or utilized in the delivery of the Services contains any date dependent routines or logic which will fail to operate correctly by reason of such date dependence; provided, however, that no representation or warranty is made as to the adequacy of any Customer or third-party service provider hardware or software used in connection with the Services. In the event of breach of the warranties set forth in this Section 5.1(b), Customer’s Sole remedy is termination pursuant to Article 10 of this MSA.
Date Compliance. (a) All Systems used and currently planned to be used in the business of the Group are and have been Date Compliant and will not cease to be so; and
(b) So far as the Seller is aware, all systems owned or used by customers or suppliers of the Group are Date Compliant and will not cease to be so.
Date Compliance. (a) For the purposes of this Agreement, date compliant means that neither performance nor functionality of any software or hardware in a Party’s Network is adversely affected by dates and in particular any software or hardware in a Party’s Network:
(i) no value for any current date will cause any interruption in operation;
(ii) date-based functionality will behave consistently for all dates;
(iii) in all interfaces and data storage, the century in any date will be specified either explicitly or by unambiguous algorithms or inferencing rules; and
(iv) all relevant years (including without limitation 2008 and 2012) will be recognised as leap years;
(b) Each Party certifies and warrants to the other that their Network (to the extent that it will affect the other Party) and the Interconnection between the Parties Networks (to the extent that it is under their control) will be date compliant before the Commencement Date.
(c) Each Party agrees and acknowledges that being date compliant is a circumstance which is essential to the integrity of the other Party’s Network. Either Party (Disconnecting Party) may, with notice, disconnect the other Party’s (Disconnected Party) Network if it fails to comply with and maintain the warranty contained in clause 14.15(b). For the sake of clarification, the right to require disconnection will be the Disconnecting Party’s sole remedy (whether in contract, tort, statute or otherwise) against the Disconnected Party for such failure.
(d) The Disconnecting Party under clause 14.15(c) must reconnect the Disconnected Party’s Network and recommence the supply of any disconnected services as soon as practicable after the Disconnected Party becomes date compliant.
Date Compliance. (a) SITA warrants that it will take necessary action and provide resources to enable all software (including software and any firmware), hardware, networks and equipment used in connection with the provision and operation of the Service (“Systems”) over which it has control to be “Date Compliant” (as described below). SITA shall use reasonable efforts to mitigate any fault in the Service caused by the non-Date Compliant Systems that it does not control but to the extent that any fault in the Service is caused by the non-Date Compliant Systems that it does not control, SITA shall not be liable to WLP for any loss or damages in the event that any such non-Date Compliance causes a fault in, or the non-availability of the Service.
(b) For the purposes of this warranty, “Date Compliant/ce” means process date data from, into and between the twentieth and twenty-first centuries and accurately perform leap year calculations. Interfaces of all Systems used in connection with the provision and operation of the Service will comply with either the ISO 8601 date format or, where applicable, the IATA Information Management Committee (IMC) date format. This warranty is to be read in conjunction with all other terms and conditions of the Agreement and shall apply to any Exhibits or future amendments which are or may be made hereto. This warranty supersedes any previous statement or contractual commitment made by SITA or WLP relating to the subject matter hereto.
Date Compliance. To the best of Company's knowledge and belief, the computer-based systems used in connection with the Business are able to operate and effectively process data that includes dates on and after January 1, 2000.

VeriCenter warrants that none of the computer hardware and software systems and equipment incorporated into or utilized in the delivery of the Services contains any date dependent routines or logic which will fail to operate correctly by reason of such date dependence; provided, however, that no representation or warranty is made as to the adequacy of any Customer or third party service provider hardware or software used in connection with the Services except for third party hardware and software provided by VeriCenter. In the event of any breach of the warranties under this Section 5.1(b), Customer’s sole remedy is termination pursuant to Article 10 of this MSA.
Date Compliance. The Contractor warrants that the system as a whole and each component of it, as applicable, is compliant with Year 2000 (Y2K) and all other dates, as specified in the business and technical requirements of the RFP. Notwithstanding any provision to the contrary in any Contractor warranty or warranties, the remedies available to the State under this Year 2000 warranty shall include repair or replacement of any element of the System whose non-compliance with the Year 2000 warranty is discovered and made known to the Contractor in writing. This warranty remains in effect for 365 days following the Warranty Period of this agreement. Nothing in this warranty shall be construed to limit any rights or remedies the State may otherwise have under this contract with respect to defects other than Year 2000 compliance. In addition, the Contractor warrants that elements of the System modified or remediated to achieve Year 2000 compliance will remain unaffected with respect to their functioning or performance except for processing and exchanging date/time data. The Contractor warrants that Deliverables not being modified or remediated directly will remain unaffected with respect to their normal functioning or performance.

Notwithstanding anything to the contrary, Vendor warrants that all Deliverables provided hereunder shall include, at no additional cost to User, both design and performance so User shall not experience the Deliverables abnormally ending and/or invalid and/or incorrect results from the Deliverables and that the Deliverables shall be otherwise “Date Compli-
