Defects In Materials. 17.1 The Client shall inspect the Materials on delivery and shall within seven (7) days of delivery (time being of the essence) notify the Contractor of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Client shall afford the Contractor an opportunity to inspect the Materials within a reasonable time following delivery if the Client believes the Materials are defective in any way. If the Client shall fail to comply with these provisions the Materials shall be presumed to be free from any defect or damage. For defective Materials, which the Contractor has agreed in writing that the Client is entitled to reject, the Contractor’s liability is limited to either (at the Contractor’s discretion) replacing the Materials or repairing the Materials.
17.2 Materials will not be accepted for return other than in accordance with 17.1 above.

13.2 Materials will not be accepted for return other than in accordance with 13.1 above and provided that:
(a) the Contractor has agreed in writing to accept the return of the Materials; and
(b) the Materials are returned at the Client’s cost within seven (7) days of the delivery date; and
(c) the Contractor will not be liable for Materials which have not been stored or used in a proper manner; and
(d) the Materials are returned in the condition in which they were delivered and with all packaging material, brochures and instr uction material in as new condition as is reasonably possible in the circumstances.
13.3 The Contractor will not accept the return of Materials for credit.

The Customer shall afford MSS an opportunity to inspect the Materials within a reasonable time following delivery if the Customer believes the Materials are defective in any way. If the Customer shall fail to comply with these provisions the Materials shall be presumed to be free from any defect or damage. For defective Materials, which MSS has agreed in writing that the Customer is entitled to reject, MSS’ liability is limited to either (at MSS’ discretion) replacing the Materials or repairing the Materials.

The Client shall afford HSE an opportunity to inspect the Materials within a reasonable time following delivery if the Client believes the Materials are defective in any way. If the Client shall fail to comply with these provisions the Materials shall be presumed to be free from any defect or damage. For defective Materials, which HSE has agreed in writing that the Client is entitled to reject, HSE’s liability is limited to either (at HSE’s discretion) replacing the Materials or repairing the Materials.
18.2 Materials will not be accepted for return other than in accordance with 18.1 above, unless at HSE’s discretion, with the items contained within inventory stock, and returned with all original packaging intact.
18.3 HSE may (at its discretion) accept the return of Goods for credit, but this may incur a restocking fee of twenty percent (20%) of the value of the returned Goods plus any freight.
18.4 Subject to clause 18.1, non stock-list items or Goods made to the Client’s specifications are not acceptable for credit or return.

For defective Materials, which Xxxx Electrical has agreed in writing that the Client is entitled to reject, Xxxx Electrical’s liability is limited to either (at Xxxx Electrical’s discretion) replacing the Materials or repairing the Materials.

For defective Materials, which the Supplier has agreed in writing that the Customer is entitled to reject, the Supplier’s liability is limited to either (at the Supplier’s discretion) replacing the Materials or repairing the Materials.
15.2 Materials will not be accepted for return other than in accordance with 15.1 above.
15.3 Subject to clause 15.1, non-stocklist items or Materials made to the Customer’s specifications are under no circumstances acceptable for credit or return.
Defects In Materials. Buyer is solely responsible for selecting the Materials, and shall precisely, clearly and unambiguously indicate and describe the Materials in the BOM. Company may choose the supplier of a Material, unless Buyer designates a specific supplier in the BOM. With respect to any Materials to be purchased by Company, COMPANY MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO THE EXTENT OR ENFORCEABILITY OF A MATERIAL SUPPLIER’S WARRANTY. With respect to any Materials to be purchased by Company, Company’s sole obligation shall be to assign to Buyer any warranties made by a Material supplier with respect to the Material so supplied, to the extent assignable, but Company does not guarantee that the supplier will comply with any of the terms of its warranty.
Defects In Materials. 12.1 You shall inspect the Materials immediately on delivery and/or installation at the Site and shall within seven (7) days of delivery and/or installation at the Site (time being of the essence) notify us of any alleged defect, deterioration, shortage in quantity, damage or failure to comply with the description or quote. You shall give us an opportunity to inspect the Materials within a reasonable time following delivery if you believe the Materials are defective in any way. If you shall fail to comply with these provisions, the Materials shall be presumed to be free from any defect or damage. For defective Materials, which we have agreed in writing that you are entitled to reject, your liability is limited to either (at our discretion) replacing the Materials or repairing the Materials.
12.2 Materials will not be accepted for return other than in accordance with clause 12.1 above.
Defects In Materials. 16.1 The Client shall inspect the Materials on delivery and shall within ten (10) days of delivery (time being of the essence) notify Moses of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Client shall afford Moses an opportunity to inspect the Materials within a reasonable time following delivery if the Client believes the Materials are defective in any way. If the Client shall fail to comply with these provisions the Materials shall be presumed to be free from any defect or damage. For defective Materials, which Moses has agreed in writing that the Client is entitled to reject, Moses’ liability is limited to either (at Moses’ discretion) replacing the Materials or repairing the Materials.
16.2 Materials will not be accepted for return other than in accordance with 16.1 above.
Defects In Materials. 17.1 The Client shall inspect the Materials on delivery and shall within seven (7) days of delivery (time being of the essence) notify the Contractor of any alleged defect, shortage in Contractor may have, if at any time the Client is in breach of any obligation (including those relating to payment and/or failure to remedy any breach in respect of this Contract within ten (10) working days of receipt by the Client of such notice/s) then the Contractor may suspend the Works immediately. The Contractor will not be liable to the Client for any loss or damage the Client suffers because the Contractor has exercised its rights under this clause. Commercial Law Xxx 0000; or
(ii) enable the Client to exercise any rights that may otherwise have been available to the Client under that Act as a direct consequence of the Contractor suspending work under this provision;
