Definition of Allowable Delay. Where there is an allowable delay (an “Allowable Delay”), then the Completion Date shall be extended for a period equivalent to the time lost by reason of such delay. The following shall be deemed to be an Allowable Delay: i. neglect or default by Client or its agent, lender, other third-party contractors of Client or any of the foregoing’s independent material suppliers; ii. governmental action or inaction, including but not limited to condemnation of the property or prohibition from entering the premises until other work is completed; or iii. any other reason or reasons beyond Company’s reasonable control, including but not limited to damage caused by fire or other casualty, strikes, force majeure events, shortage of materials or labor, transportation delays, weather conditions, change orders, or deficiencies in this Agreement.

However, nothing in paragraph 8.a.(6) that may apply to the obligations undertaken pursuant to the CIA affects the status of costs that are not allowable based on any other authority applicable to Pfizer.
