Definition of Shifting Patterns. A rotoplan, or any other type of shift work organization may be implemented in a unit within the Centre, or part thereof, with the agreement of the Managers and the employees and approval of the Union. a) Shifting patterns are defined as follows: i) 12-hour rotoplans consisting of no more than four (4) shifts in a row and no more than twenty-eight (28) shifts in a nine (9) week period. ii) 8-hour rotoplans consisting of no more than six (6) shifts in a row (with the exception of seven (7) shifts on nights) and no more than twenty-eight (28) shifts in a six (6) week period. iii) Two (2) week bookings consisting of no more than six (6) shifts in a row and no more than fourteen (14) shifts in a three (3) week period. iv) 10-hour rotoplans, consisting of no more than four (4) shifts in a row and no more than fifty-six (56) shifts in a fifteen (15) week period. b) Employees working 8-hour shifts shall rotate through the designated shifts in the following order: i) night (1st) shift; ii) evening (3rd) shift; and iii) day (2nd) shift. Employees will be assigned to no more than two (2) consecutive first and/or third shifts. c) On two (2) week bookings, swing shifts shall be considered between the second and third shift only. Definition of Shifting Patterns. ‌ A rotoplan, or any other type of shift work organization may be implemented in a work unit with the agreement of the Managers and a seventy-five (75) per cent majority of all of the permanent employees of the home(s) or work unit and approval of the Union. a) Shifting patterns are defined as follows: i) 12-hour rotoplans consisting of no more than four (4) shifts in a row and no more than twenty-eight (28) shifts in a nine (9) week period. ii) 8-hour rotoplans consisting of no more than six (6) shifts in a row [with the exception of seven (7) shifts on nights] and no more than twenty-eight (28) shifts in a six (6) week period. iii) 10-hour rotoplans, consisting of no more than four (4) shifts in a row and no more than fifty-six (56) shifts in a fifteen (15) week period. b) Employees will be assigned to no more than two (2) consecutive second and/or third shifts. By mutual agreement at the local level, this requirement may be waived to build greater flexibility into shift arrangements. c) A rotoplan shall remain in full force and effect unless written notice is given by either party to discontinue the rotoplan at least six (6) weeks in advance. The rotoplan will remain in effect until a new shift arrangement is agreed upon. If no agreement is reached within six (6) weeks as per above (an extension may be mutually agreed to by the parties), the Employer will implement an eight (8) hour schedule as per Article 13.02 c) or 16.01 a) ii) and any other related provisions will apply. d) The parties are agreed that the implementation of an extended shift schedule will result in no increase in operational costs to the Employer and no decrease in the wages and benefits of the employees.

Employees will be assigned to no more than two consecutive second and/or third shifts. c) On two-week bookings, swing shifts shall be considered between the second and third shift only. Only one swing shift is allowed per week and between days off. One employee per two-week booking may be booked to this shift.

Any adjustment of the Purchase Price and the number of shares of Common Stock issuable upon exercise of this Warrant with respect to this Section 5.2 which relates to warrants, options or other subscription or purchase rights with respect to shares of Common Stock shall be disregarded if, as, and to the extent that such warrants, options or other subscription or purchase rights expire or are canceled without being exercised, so that the Purchase Price effective immediately upon such cancellation or expiration shall be equal to the Purchase Price that otherwise would have been in effect at the time of the issuance of the expired or canceled warrants, options or other subscriptions or purchase rights, with such additional adjustments as would have been made to that Purchase Price had the expired or cancelled warrants, options or other subscriptions or purchase rights not been issued.
