DEFINITIONS AND GENERAL TERMS. The provisions set forth in Seller’s Definitions and General Terms, which are posted under the Terms & Conditions link at xxx.xxxxxxxxxxxxxxxxx.xxx/xxxxx, as of the Effective Date (the “Definitions and General Terms”) are hereby incorporated into this Agreement by reference and made a part hereof for all purposes as if fully set forth herein. In addition to terms or phrases defined elsewhere in the Master Services Agreement, in any Product Supplement or in any other part of this Agreement, where capitalized in this Agreement, the terms or phrases defined in the Definitions and General Terms shall have the meanings set forth therein.
DEFINITIONS AND GENERAL TERMS. “Software” means any computer programs, software applications, apps or the like, including both machine-readable object code (or executable code) and source code, and any subsequent updates to said software supplied by its owner, and further including any and all related user manuals and product documentation provided or made available by its owner. “System Software” means Software created by B&R that is a development studio used to create applications. “Application Software” means Software created using the System Software and primarily designed to control B&R hardware devices. All Software is a subset of Technology as defined herein, therefore terms related to Background Intellectual Property and Foreground Intellectual Property apply to Software as well, unless any conflicting terms are provided in this section, in which case this section governs for Software.

DEFINITIONS AND GENERAL TERMS. 1. A grievance is defined to be a complaint by the Union and/or an employee or group of employees that there has been a violation, misinterpretation, or misapplication of the terms of this Agreement. 2. No reprisals of any kind shall be taken by the Board or Administration against any employee because of his/her participation in any of these grievance procedures. 3. The failure of an Administrator to give a decision within the time limits shall permit the grievant to proceed to the next step. The time limits may be extended by mutual written agreement. 4. When hearings or conferences pertaining to a grievance are held during school hours, all employees whose presence is required shall be excused, with pay, for that purpose. 5. As used in this Article “days” shall mean employment days, except during the summer recess when it shall mean days on which the Executive Director’s office shall be open. 6. The Employer acknowledges the right of the Union’s grievance representative to participate in the processing of a grievance at any level. It is further understood that no employee shall be required to discuss any grievance if the Union representative is not present. 7. A grievance may be withdrawn at any level without establishing precedent, and if withdrawn shall be deemed as though never having been filed.
DEFINITIONS AND GENERAL TERMS. In this Secured Credit Card Agreement (“Agreement”), "we," "us," "our" and "Bank" refers to Green Dot Bank and its assignees. You are the person or persons who applied to us for a secured VISA or MasterCard credit card account (“Account”). We have approved your Application and received your initial deposit (the “Initial Deposit”) for your savings account (the "Savings Account"). We have opened an Account for you with an initial Credit Limit equal to the amount of the Initial Deposit. The Initial Deposit plus any amounts you may later add to the Savings Account secures payment of your Account obligations. You must maintain the Savings Account with us at all times in connection with your Account and you may not allow the amount of the Savings Account to decline below the greater of $200 or the full amount of principal, Interest Charges and Fees outstanding under the Account. The Account will be considered to be separate from any other credit card account you may have with us. This Agreement will become effective when: (1) you sign the MasterCard or VISA credit card issued in connection with your Account (the “Card”); (2) you use (or someone you authorize uses) the Card; (3) 30 days pass after the Card is issued to you; or (4) you call and activate the Card, whichever occurs first. You agree to sign your Card as soon as you receive it. HOWEVER, YOU MAY STILL REJECT THIS AGREEMENT, PROVIDED THAT YOU HAVE NOT YET USED THE ACCOUNT OR PAID A FEE AFTER RECEIVING A BILLING STATEMENT. DEFINITIONS AND GENERAL TERMS. 1. A grievance is defined to be a complaint by any employee or the Union that there has been a violation, misinterpretation, or misapplication of this Agreement. 2. Nothing contained herein shall be construed as limiting the right of any employee having a grievance to discuss the matter informally with any appropriate member of the administration and having the grievance adjusted without the intervention of the Union provided the adjustment is not inconsistent with the terms of this Agreement and that the Union has been given an opportunity to be present at such adjustment. Any final disposition of a grievance determined by the Union to be in conflict with this Agreement shall be grievable by the Union. 3. The parties shall make a sincere and determined effort to settle meritorious grievances in the steps of the grievance procedure and to keep the procedure free of unmeritorious grievances. 4. No reprisals of any kind shall be taken by the Board or the Administration against any employee because of his/her participation in any of these grievance procedures. 5. The failure of an employee or the Union to act on any grievance within the prescribed time limits shall act as a bar to any further appeal and an administrator's failure to give a decision within the time limits shall permit the grievant to proceed to the next step. The time limits may be extended by mutual written agreement 6. If any organization is to represent an employee, that organization shall be the Union or its representative. 7. Hearings and conferences under the procedure shall be conducted at a time and place which shall afford a fair and reasonable opportunity for all persons, including witnesses entitled to be present, to attend and shall be held, insofar as possible after regular school hours, or during non-work time of personnel involved. When such hearings and conferences are held with the approval of the Superintendent or designee during school hours, all employees whose presence is required shall be excused, with pay, for that purpose. 8. As used in this Article, "days" shall mean employee employment days, except during the summer recess when it shall mean days on which the District Business Office is open.
