Common use of DELAY OR FAILURE TO EXERCISE RIGHTS Clause in Contracts

DELAY OR FAILURE TO EXERCISE RIGHTS. No exercise, delay in exercising or failure to exercise any right arising under this Agreement, no act or omission of any holder of Lease Obligation or Lease Claim in respect of UASC and UCS or any other person or entity or any collateral security for any Lease Obligation or Lease Claim or any right arising under this Agreement or the Collateral Agreements, no change, impairment, or suspension of any right or remedy of any holder of any Lease Obligation or Lease Claim, and no other act, failure to act, circumstance, occurrence or event which, but for this provision, would or could act as a release or exoneration of the obligations of the Physician hereunder shall in any way affect, decrease, diminish or impair any of the obligations of the Physician under this Agreement or give the Physician or any other person or entity any recourse or defense against any holder of a Lease Obligation or Lease Claim in respect of any right arising under this Agreement.
