Delivery of Initial Provisioning Material. 2.6.1 During the Initial Provisioning Period, Initial Provisioning Material will conform to the latest known configuration standard of the Aircraft for which such Material is intended as reflected in the Provisioning Data transmitted by the Seller.
2.6.2 The delivery of Initial Provisioning Material will take place according to the conditions specified in the commercial offer mentioned in Article 2.5.
2.6.3 All Initial Provisioning Material will be packaged in accordance with ATA 300 Specification.
Delivery of Initial Provisioning Material. 2.7.1 To support the operation of the Aircraft, the Seller will use its best efforts to deliver Initial Provisioning Material in Subparagraph 1.1(a) of this Letter Agreement against the Buyer's orders from the Seller and according to the following schedule, provided the orders are received by the Seller in accordance with published lead time: Each block of Aircraft referred to in the schedule below will be defined in the Initial Provisioning Conference.
(a) At least fifty percent (50%) of the ordered quantity of each Line Replacement or Line Maintenance item three (3) months before delivery of the first Aircraft of each block of Aircraft for which the Buyer has placed Initial Provisioning orders for Material defined above in Subparagraph 1.1(a).
(b) At least seventy-five percent (75%) of the ordered quantity of each Line Replacement or Line Maintenance item one (1) month (for items identified as line station items, two (2) months) before delivery of the first Aircraft of each block of Aircraft for which the Buyer has placed Initial Provisioning orders for Material defined above in Subparagraph 1.1(a).
(c) Fifty percent (50%) of the ordered quantity of each item except as specified in Subparagraphs 2.7.1
(a) and 2.7.1 (b) above at delivery of the first Aircraft of each block of Aircraft for which the Buyer has placed Initial Provisioning orders for Material defined above in Subparagraph 1.1(a).
(d) One hundred percent (100%) of the ordered quantity of each item, including line station items, three (3) months after delivery of the first Aircraft of each block of Aircraft for which the Buyer has placed Initial Provisioning orders for Material, as defined above in Subparagraph 1.1(a). If said one hundred percent (100%) cannot be accomplished, the Seller will have such items available at its facilities for immediate supply, in case of an AOG.
2.7.2 In the event that less than eighty-five percent (85%) of the Buyer's orders of Initial Provisioning Material defined above in Subparagraph 1.1(a), supporting each block of Aircraft (the "IP Block"), is delivered by the Seller to the Buyer in accordance with the provisions set forth above in Subparagraph 2.7.1
Delivery of Initial Provisioning Material. 2.1.6.1 During the Initial Provisioning Period, Initial Provisioning Material shall conform to the latest known configuration standard of the Aircraft for which such Initial Provisioning Material is intended and to the Initial Provisioning Data transmitted by the Seller.
2.1.6.2 Provided such orders are received by the Seller in accordance with the leadtime published in the applicable Spare Parts Price Catalog, the Seller shall use commercially reasonable efforts to deliver Initial Provisioning Material as per Article 1.2.1 (i) of this Exhibit “H” against the Buyer’s orders and according to the following schedule:
(a) at least [*] of the ordered quantity of each item for which the Buyer has placed Initial Provisioning orders for Material defined in Article 1.2.1 (i) above [*] before Delivery of the first Aircraft; AVA - A320 Family PA AMENDED AND RESTATED
(b) [*] of the ordered quantity of each item for which the Buyer has placed Initial Provisioning orders for Material, as defined in Article 1.2.1 (i) above, three (3) months after Delivery of the first Aircraft. If said [*] cannot be accomplished, the Seller shall endeavor to have such items available at its facilities for immediate supply, in case of an AOG.
2.1.6.3 The Buyer may cancel or modify Initial Provisioning orders placed with the Seller, with no cancellation charge, provided such modification or cancellation occurs no later than the published lead-time before the scheduled delivery of said Material. If such cancellation or modification (resulting on a decrease of the order size) occurs within the published leadtime of any Materials Seller may charge a fee for such cancelled Material to cover Seller’s cost in connection with such cancellation. The cancellation fee payable by Buyer in connection with the cancellation or modification of Inintial Provisioning orders placed with the Seller shall be agreed by the parties in the Commercial Offer as per 2.1.5.
2.1.6.4 The delivery of Material described in Articles 1.2.1 (ii) thru (vi) shall take place as set forth in Article 2.2 hereof.
Delivery of Initial Provisioning Material. 2.9.1 To cover the requirements in Material for entry into service of the Aircraft, the Seller shall use its reasonable efforts to deliver Material ordered during the Initial Provisioning Period against the Buyer’s orders and according to a mutually agreed schedule. Such deliveries shall cover the Material requirements in line with the Aircraft fleet build up, only up to that portion of the ordered quantity that is recommended for the number of Aircraft operated during the Initial Provisioning Period. The Seller shall in addition use its reasonable efforts to cause Suppliers to provide to the Buyer a similar service for their items.
2.9.2 The Buyer may, subject to the Seller’s agreement, cancel or modify Initial Provisioning orders placed with the Seller, with no cancellation charge, not later than the quoted lead-time before scheduled delivery of said Material.
2.9.3 In the event of the Buyer cancelling or modifying (without any liability of the Seller for the cancellation or modification) any orders for Material outside the time limits defined in Clause 2.9.2, the Buyer shall reimburse the Seller for any costs incurred in connection therewith.
2.9.4 All transportation costs for the return of Material under this Clause 2, including any insurance, customs and duties applicable or other related expenditures, shall be borne by the Buyer.
Delivery of Initial Provisioning Material. 2.7.1 Provided that orders are received by the Seller in accordance with the leadtime published in the Seller’s Spare Parts Price Catalog, the Seller will deliver Initial Provisioning Material in accordance with the Buyer’s orders, subject to reasonable quantities.
2.7.2 The Buyer, subject to the Seller’s agreement, may cancel or modify Initial Provisioning orders placed with the Seller with no cancellation charge as follows:
(a) Material having a lead time […***…], not later than […***…] before scheduled delivery of said Material,
(b) Material with a lead time of […***…], not later than […***…] before scheduled delivery of said Material, HAL – A320 Family LA1-9 HAL A321 PA – LA1 […***…] *** Confidential Treatment Requested

2.7.2 The Buyer, subject to the Seller’s agreement, may cancel or modify Initial Provisioning orders placed with the Seller with no cancellation charge as follows:

Delivery of Initial Provisioning Material. During the Initial Provisioning Period, Material will conform with the latest configuration standard of the affected Aircraft and with the Initial Provisioning Data transmitted by the Seller. The Seller, in addition, will use its reasonable efforts to cause Suppliers to provide a similar service for their items. Should the Seller default in this obligation, it will immediately replace such Seller parts and/or authorize return shipment at no transportation cost to the Buyer. The Buyer will make reasonable efforts to minimize such cost.
