Common use of Delivery of the Mortgage Files Pursuant to Sale and Servicing Agreement Clause in Contracts

Delivery of the Mortgage Files Pursuant to Sale and Servicing Agreement. As is appropriate for the servicing or foreclosure of any Mortgage Loan, the Indenture Trustee shall deliver to the Servicer (if directed in writing by the Servicer) the Indenture Trustee’s Mortgage Files for such Mortgage Loan upon receipt by the Indenture Trustee on or prior to the date such release is to be made of: (a) such Officer’s Certificates, if any, as are required by the Sale and Servicing Agreement; and (b) a Request for Release, executed by the Servicer, providing that the Servicer (if directed in writing by the Servicer) will hold or retain the Indenture Trustee’s Mortgage Files in trust for the benefit of the Indenture Trustee and the Holders of Notes.
