Delivery Windows. UPS may provide UPS My Choice Members an estimated delivery window (typically a four hour window) for inbound shipments. By UPS establishing an estimated delivery window it is not guaranteeing delivery of the shipment during such window. UPS may provide UPS My Choice Personal Members the ability to choose two hour delivery window for a shipment. If the window You select is confirmed by UPS, UPS guarantees to deliver the shipment in the selected window. If UPS is unable to deliver the shipment before the end of the confirmed window, your sole and exclusive remedy will be that UPS will not charge the fees for delivery in the confirmed window. UPS will have no liability for any damages based on its failure to deliver the shipment before the end of the confirmed window.

After the initial development of the Delivery Schedule, a designated WO employee and UNFI will meet monthly, if requested by WO or UNFI, or quarterly, if no monthly meetings are held, to review the Schedule and make any necessary modifications. Delivery Windows. The Distributor shall deliver orders of Products within a three (3) hour window around the scheduled delivery time ~, not before, but not after, 11/2 hours of the scheduled delivery time) for each of the Stores no more than 500 miles from the Distribution Center designated herein to serve such Stores, or within a five (5) hour window of the scheduled delivery time ~, not before, but not after, 21/2 hours of the scheduled delivery time) for each of the Stores more than 500 miles from the Distribution Center designated herein to serve such Stores.   • Delivery Times 4.1 The delivery times agreed with regard to (parts of) the Performance to be delivered by the Supplier shall be binding. If these delivery times are exceeded, the Supplier shall automatically be in default under the Agreement without notice of default being required to that effect. 4.2 For each calendar day by which the aforesaid delivery times are exceeded, the Supplier shall pay to Wavin an amount of 0.5% of the total sum agreed with a maximum of 10%, which is a genuine pre-estimate of the losses incurred by Xxxxx. 4.3 The Supplier shall always be obliged to provide Wavin in time, and in all cases within 24 hours after the Supplier became aware of this or should reasonably have foreseen this, with adequate and written notification of its impending failure to meet the delivery time. Execution of the Agreement in partial deliveries shall require Xxxxx’s prior written consent. If Wavin so requests, the Supplier shall be obliged to submit a written production or execution schedule and/or to cooperate in progress monitoring.

  • Delivery Point The delivery point is the point of delivery of the Power Product to the CAISO Controlled Grid (the “Delivery Point”). Seller shall provide and convey to Buyer the Power Product from the Generating Facility at the Delivery Point. Title to and risk of loss related to the Power Product transfer from Seller to Buyer at the Delivery Point.
