Common use of Demand for Arbitration Clause in Contracts

Demand for Arbitration. a. The Association may appeal arbitrable grievances to grievance arbitration under and in accordance with the rules of the American Arbitration Association in effect at the time. Notice of such appeal must be taken within ten (10) school days following the receipt of the District’s determination at Step 2. b. Within twenty (20) school days following notice of appeal demand for arbitration shall be made by written submission defining the issue to be arbitrated. The District shall then have ten (10) school days within which to reply to such submission by filing same with the American Arbitration Association. c. The Association or the Board may not raise in any arbitration hearing any issue which was not previously submitted in writing, which defines the issue or issues to be arbitrated.
