Derived Data. Hitachi may collect and transfer Derived Data to its Affiliates, Personnel, contractors or vendors at any time and without notifying You. You grant Hitachi, its Affiliates and their respective Personnel a worldwide, royalty-free, non-exclusive right and license to use, copy, modify and sub-license the Derived Data for the purposes of service delivery, improvement and development.

Derived Data. 3.3.1 Licence fees, as detailed in Schedule B of this Agreement, apply to all Customers using the Data to calculate indices for commercial distribution (whether distributed real time, delayed or end of day). All such indices created from the Data must also be made available by the Customer on a non-discriminatory basis and under reasonable commercial terms. 3.3.2 Customers may also choose to utilise real time Data to create other derived data values and/or benchmarks, often referred to as Original Works. No Data Charges are payable for the internal or external distribution of such Original Works provided they cannot be reverse engineered in any way back to the underlying Data, and/or effectively substituted for that Data. In the event that an Original Work can be reverse engineered, or used as a substitute, Data Charges as detailed in Schedule B will apply. If you require further clarification on a specific instance please contact the relevant Exchange before utilising the Data in this way.
Derived Data. Customers and End Customers may utilise the Data to create Customer Materials. No Charges are payable for internal or external distribution of Customer Materials provided that the Customer Material cannot be reverse engineered in any way back to the underlying Data or used as a substitute for the underlying Data. In the event that the Customer Material can be reverse engineered or used as a substitute Charges will apply. If you require further clarification on a specific instance please contact Turquoise before utilising Data in this way. Redistributors should clearly state and display on their products that Turquoise is the original source of the Data.
Derived Data. Except for the Data that may be included in Derived Data, Subscriber represents and warrants to Provider that it owns all right, title and interest in and to the Derived Data, including all Proprietary Rights therein. Nothing in this Agreement will be construed or interpreted as granting to Provider any right, title or interest or except as expressly provided herein, any other Proprietary Rights in or to the Derived Data.
Derived Data. For Services where Verifone is collecting or processing transaction data for Merchant, Merchant acknowledges that Verifone may collect and share with partners data from Merchant’s transactions, with any sharing in aggregate and anonymous form only (for statistical and other purposes); however, such data shall not include any “cardholder data” under Payment Card Industry Security Standard’s Council rules, any of Merchant’s or a customer’s personally identifiable information, Merchant’s or a customer’s personal financial information or any other data that Verifone may be prohibited from collecting or sharing under applicable privacy laws. Merchant agrees that Verifone may use such data for purposes of data analytics and optimizing or otherwise enhancing its products and services. Verifone will comply with all applicable laws and regulations with respect to any use, sharing and dissemination of this data. In accordance with Verifone’s use of derived data, Verifone reserves the right to anonymously track and report Merchant’s activity inside of the Point Service components. This paragraph shall survive any expiration or termination of this Agreement.
Derived Data. The Site Owner may only use Derived Data for its own internal business purposes. The Site Owner may only distribute or display Derived Data with the consent of ICE Data. Further, the Site Owner shall ensure that the contractual documentation which it has in place with its users shall prohibit those users from applying a methodology or other form of manipulation to Delayed Pricing Data which such user receives from the Site Owner.

For example, the system is able to calculate from the data streams the current collaboration situation like the number of contribution for the categories of a brainstorming session or information about the behavior of a group.

Derived Data. “Derived Data” means any data that Collective derives from Patient Data, Administrative Data, or Transaction Data that does not include Subscriber’s Confidential Information or any Patient Data or other personally identifiable information. Subscriber hereby acknowledges and agrees that the Derived Data is owned by, and is the exclusive property of Collective, and that Collective may use, disclose, market, license, distribute, sell, receive remuneration for, create derivative works of, and otherwise commercialize the Derived Data for any legally permissible purpose without restriction.
Derived Data. Toloka may use and disclose for any purpose data that is derived from Customer Content and that does not reasonably identify Customer. By way of example and without limitation, Toloka may use such derived data to: 4.3.1. track the number of users and uses of Services on an anonymous aggregate basis as part of Toloka marketing efforts to publicize the statistics or aggregated data on usage of Toloka Platform; 4.3.2. analyze usage patterns for product development efforts; and • 4.3.3. develop further analytic frameworks and application tools.
Derived Data. 10.1. Notwithstanding anything to the contrary contained in the Agreement, the Customer shall not be entitled to distribute or otherwise disseminate Derived Data in any way or form to any person other than a Customer Affiliate without the prior written consent of the JSE. 10.2. Subject to, and without limiting the generality of clause 10.1, the Customer shall: 10.2.1. not brand Derived Data as JSE Data; 10.2.2. not state, imply nor do anything to create the impression that the Derived Data is approved or calculated by the JSE, nor that the JSE is in any way responsible (directly or indirectly) for the creation and/or supply of the Derived Data; and 10.2.3. state that the Derived Data is created by the Customer. 10.3. In the event that any Derived Data is distributed or otherwise disseminated either (i) without the requisite consent contemplated in clause 10.1 or (ii) in such a manner by the Customer or any Customer Affiliate that the underlying Data from which such Derived Data was derived or on which it was based, can be determined (by calculation, reverse-engineering or by any other means), the Customer shall be obliged to pay the applicable Consideration, based upon the nature of the Data from which the Derived Data originated, as may be set out in the Indices Price List and shall comply with such terms and conditions in relation to such distribution or dissemination as the JSE may prescribe. 10.4. If the JSE has reasonable grounds to believe that the Customer is infringing the provisions of this clause 10, the Customer shall provide the JSE with such information as may be reasonably necessary, and within a reasonable period following a request by the JSE, in order to satisfy the JSE that there has not been a contravention of this clause 10. 10.5. The JSE shall, at all times, remain the owner of the Data which forms part of and/or was used to create the Derived Data.
