DISCLOSURE FOR OLDER PROPERTIES. Properties built on or before 1981 will contain a general disclosure about the possibility of materials containing asbestos being commonly used in construction until that time. This disclosure is not a requirement of Law the same as a Lead Based Paint Disclosure required for properties being leased or sold that were built before 1978, the Asbestos Disclosure is a requirement of the Broker. The Broker informs the Owner that they have an Affirmative Duty to disclose whether or not they have “actual knowledge” of materials containing asbestos in the premises or if they have knowledge of an inspection for asbestos has been conducted for the premises.
