Disclosure in Writing. NCSU and Licensee agree that any information to be treated as confidential information under this Article 13 must be disclosed in writing or in another tangible medium and must be clearly marked “CONFIDENTIAL”. Information disclosed orally must be summarized and reduced to writing and communicated to the other party within thirty (30) days of such disclosure.
Disclosure in Writing. Reference to disclosure in writing herein shall, in the case of disclosure to Purchaser, include disclosure in writing to Purchaser or its representatives or, in the case of disclosure to Western, include disclosure in writing to Western or its representatives.
Disclosure in Writing. The phrase “except as previously disclosed in writing” and similar expressions used in this Agreement shall be construed for all purposes of this Agreement as referring to the Disclosure Letter. Disclosure by the Company in any particular schedule or exhibit of the Disclosure Letter will be deemed to be disclosure of the information for all purposes of this Agreement.
Disclosure in Writing. Reference to disclosure in writing herein shall, in the case of disclosure to Penn West, include disclosure to Penn West or its representatives, or in the case of disclosure to Petrofund, include disclosure to Petrofund or its representatives.
Disclosure in Writing. Reference to disclosure in writing herein shall, in the case of the Trust and True, include disclosure to the Trust, True or their representatives, or in the case of Shellbridge, include disclosure to Shellbridge or its representatives.
Disclosure in Writing. Reference to disclosure in writing herein shall, in the case of disclosure to Harvest, include disclosure to Harvest or its representatives, or in the case of disclosure to Viking, include disclosure to Viking or its representatives.
Disclosure in Writing. Reference to disclosure in writing herein shall, in the case of Southtech, include disclosure to Southtech or its Representatives and in the case of Redfall, include disclosure to Redfall or its Representatives.
Disclosure in Writing. Reference to "disclosed in writing" on or prior to the Agreement Date herein shall, in the case of disclosure to Baytex be references exclusively to the Raging River Disclosure Letter or this Agreement, or in the case of disclosure to Raging River be references exclusively to the Baytex Disclosure Letter or this Agreement.
Disclosure in Writing. References to "disclosed in writing" shall include: (i) all documents that prior to January 10, 2020 were provided or included in the electronic data room maintained by Corridor or any agent or advisor of Corridor and for which such Persons of the Initial Investor Group and the Initial Investor Group's legal counsel, as requested, have been provided access to; (ii) all documents or information provided by electronic correspondence to any Person within the Initial Investor Group or the Initial Investor Group's legal counsel prior to the Agreement Date, and (iii) all documents or information personally provided to any Person within the Initial Investor Group or the Initial Investor Group's legal counsel prior to the Agreement Date.
Disclosure in Writing. References to “disclosed in writing”, “except as previously disclosed in writing” and similar expressions in this Agreement shall in the case of disclosure by the Company, be construed for purposes of this Agreement as referring to matters disclosed in (%3) the Company Disclosure Letter; (%3) the Company Filings and prior to the date that is three (3) Business Days prior to the date of this Agreement; (%3) this Agreement or in the Schedules hereto; and (%3) the Company Data Room; and in the case of disclosure by the Purchaser, be construed for purposes of this Agreement as referring to matters disclosed in (a) the Purchaser Disclosure Letter; (b) the Purchaser Filings and prior to the date that is three (3) Business Days prior to the date of this Agreement; (c) this Agreement or in the Schedules hereto; and (d) the Purchaser Data Room.
