Disqualified Institutions Sample Clauses

The Disqualified Institutions clause defines specific entities or categories of entities that are prohibited from participating in a transaction, such as lenders or investors in a loan agreement. Typically, this clause lists competitors, hostile parties, or other groups deemed unsuitable by the borrower or issuer, and may include affiliates of such entities. Its core function is to protect the interests of the party imposing the restriction by preventing sensitive information or control from falling into the hands of adversarial or conflicted parties, thereby reducing business risk and maintaining strategic advantage.
