Documents Forming the agreement. 2.1 This Introduced Client Application Form, together with the Introduced Client Terms of Business and the Modulr Account Terms and Conditions constitute the entire agreement between Modulr and the Introduced Client (collectively referred to as the "parties" and individually a "party") (together the “Agreement”).
2.2 The parties agree that to the extent there is any inconsistency between the terms in the documents that comprise the Agreement:
(a) The Introduced Client Application Form shall be the primary source used to determine any disputes between the parties in respect of services to be provided by Modulr and any Fees payable under this Agreement and shall prevail over the Introduced Client Terms of Business and the Modulr Account Terms and Conditions and any Schedule;
(b) Subject to 2.2(a) above, in the case of any inconsistency between the Introduced Client Terms of Business and the Modulr Account Terms and Conditions then the Modulr Account Terms and Conditions shall prevail over the Introduced Client Terms of Business.
2.3 Unless expressly stated otherwise in this Introduced Client Application Form:
(a) the definitions contained in the Modulr Account Terms and Conditions apply to this Introduced Client Application Form and the Introduced Client Terms of Business;
(b) the definitions and rules of interpretation contained in the Introduced Client Terms of Business apply to this Introduced Client Application Form and the Modulr Account Terms and Conditions;
(c) a reference clause is a reference to a clause in this Introduced Client Application Form.
