Common use of DOMICILIUM Clause in Contracts

DOMICILIUM. 24.1. The PURCHASER hereby chooses as his domicilium citandi et executandi for all purposes under this Agreement, whether in respect of Court process, notices or other documents or communications of whatever nature, the following address: PHYSICAL ADDRESS FAX NO EMAIL CELL NUMBER TEL NUMBER 24.2. Any notice or communication required or permitted to be given in terms of this Agreement shall be valid and effective only if in writing but it shall be competent to give notice by telefax. 24.3. Any notice by the SELLER: - 24.3.1. sent by prepaid registered post in a correctly addressed envelope to the PURCHASER at his domicilium citandi et executandi shall be deemed to have been received on the fifth business day after posting (unless the contrary is proved); 24.3.2. delivered by hand to a responsible person during ordinary business hours at the physical address chosen as the PURCHASER’S domicilium citandi et executandi shall be deemed to have been received on the day of delivery; and 24.3.3. sent by telefax to the PURCHASER’S chosen telefax number stipulated in clause 24.1 herein shall be deemed to have been received on the date of despatch (unless the contrary is proved). 24.4. Notwithstanding anything to the contrary herein contained, a written notice or communication received by the PURCHASER shall be an adequate written notice or communication to the PURCHASER notwithstanding that it was not sent or delivered to the PURCHASER’S domicilium citandi et executandi.

Any notice by the SELLER: SELLER :- 24.3.123.3.1. sent by prepaid registered post in a correctly addressed envelope to the PURCHASER at his domicilium citandi et executandi shall be deemed to have been received on the fifth business day after posting (unless the contrary is proved); 24.3.223.3.2. delivered by hand to a responsible person during ordinary business hours at the physical address chosen as the PURCHASER’S domicilium citandi et executandi shall be deemed to have been received on the day of delivery; and 24.3.323.3.3. sent by telefax to the PURCHASER’S chosen telefax number stipulated in clause 24.1 23.1 herein shall be deemed to have been received on the date of despatch (unless the contrary is proved). 24.423.4. Notwithstanding anything to the contrary herein contained, a written notice or communication actually received by the PURCHASER shall be an adequate written notice or communication to the PURCHASER notwithstanding that it was not sent or delivered to the PURCHASER’S domicilium citandi et executandi.

DOMICILIUM. 24.1. 19.1 The PURCHASER hereby chooses as his domicilium citandi et executandi (the address for all purposes under this Agreement, whether in respect delivery of Court process, notices or other documents or communications of whatever natureand court documents) and as the address at which notices may be delivered to him, the following address: PHYSICAL ADDRESS FAX NO EMAIL CELL NUMBER TEL NUMBERaddresses set out in the heading to the CONTRACT OF SALE. 24.2. 19.2 Any notice or communication required or permitted to be given in terms of this Agreement shall be valid and effective only if in writing but it shall be competent to give notice by telefax.the PURCHASER: 24.3. Any notice by the SELLER: - 24.3.1. 19.2.1 sent by prepaid registered post (by airmail if appropriate) in a correctly addressed envelope to the PURCHASER at his domicilium citandi et executandi PURCHASER'S postal address set out in the heading to this CONTRACT shall be deemed to have been received on the fifth business 7th day after posting (unless the contrary is proved);; or 24.3.2. 19.2.2 delivered by hand to a responsible person during ordinary business hours at the physical address chosen as the PURCHASER’S its domicilium citandi et executandi shall be deemed to have been received on the day of delivery; and 24.3.3. sent by telefax to the PURCHASER’S chosen telefax number stipulated in clause 24.1 herein executandi, shall be deemed to have been received on the date of despatch delivery; or 19.2.3 sent by telefax or email to its chosen telefax number or email address shall be deemed to have been received on the date of dispatch (unless the contrary is proved). 24.4. 19.3 Notwithstanding anything to the contrary herein containedcontained herein, a written notice or communication actually received by the PURCHASER (including any notice facsimiled or emailed to the PURCHASER) shall be an adequate written notice or communication to the PURCHASER it, notwithstanding that it was not sent or delivered to the PURCHASER’S its chosen domicilium citandi et executandi.
