DRUG AND ALCOHOL TESTING PROGRAM AND POLICY. Applicable Subrecipients and each of their subcontractors with safety-sensitive employees shall have a drug and alcohol testing program and written policy in place that comply with alcohol and controlled substance testing standards established by the FTA, as defined in 49 CFR Part 655 and 49 CFR Part 40. The program requires Subrecipients to conduct pre-employment, reasonable suspicion, random, return-to- duty, and post-accident testing of public transportation employees responsible for safety- sensitive functions. The State will monitor Subrecipients for compliance with the regulations.
