Drug Testing Procedures. a. The testing procedures and safeguards provided in this policy shall be adhered to by any laboratory personnel administering departmental drug tests. b. Laboratory personnel authorized to administer departmental drug tests shall require positive identification from each employee to be tested before the employee enters the testing area. c. In order to prevent a false positive test result, a pre-test interview shall be conducted by testing personnel to ascertain and document the employee’s recent use of any prescription or non-prescription drugs, or any indirect exposure to drugs. d. The testing area shall be private and secure. If it is established that the employee’s specimen has been intentionally tampered with or substituted by the employee, the employee is subject to discipline as if the specimen tested positive. In order to deter adulteration of the urine specimen during the collection process, physiologic determinations such as creatinine, specific gravity and/or chloride measurements may be performed by the laboratory. Any findings by the laboratory outside the “normal” ranges for creatinine, specific gravity and/or chloride shall be immediately reported to the Employer so that another specimen can be collected without undue delay. The clinic shall also immediately notify the MRO. f. Where the employee appears unable or unwilling to give a specimen at the time of the test, testing personnel shall document the circumstances on the drug-test report form. The employee shall be permitted no more than two (2) hours to give a sample. During that time, the employee shall remain in the testing area, which shall remain under the observation and control of the clinic personnel. Direct observation of the employee producing the sample is prohibited. Reasonable amounts of water may be given to the employee to encourage urination. The collective bargaining parties retain the right to inspect the laboratory to determine conformity with the standards described in this policy shall policy. The laboratory will only test for alcohol and the illegal drugs listed in the Definition Section of this Policy and Attachment 1. Alcohol tests shall be by breathalyzer. An employee/applicant presenting himself/herself at a Substance Abuse Prevention Coordinator- approved drug collection site must have a minimum of one piece of government-issued photo identification and may not leave the collection site for any reason – unless authorized by the collection agency – until he/she has fully completed all collection procedures. Failure to follow all collection procedures will result in the employee’s recent use of any prescription or non-prescription drugs, or any indirect exposure /applicant being classified as “refusing to drugs.

H. Whenever there is a reason to believe that the employee may have altered or substituted the specimen to be provided, a second specimen shall be obtained within a reasonable period of time. The container shall be sealed in the employee’s presence and the employee shall be asked to initial or sign the container. The container shall be sent to the designated testing laboratory technicianon that day or the earliest business day by the fastest available method. The same procedure shall be followed for a blood test.
3. A chain of possession form shall be completed by the hospital, laboratory and/or clinic personnel during the specimen collection and checked against attached to and mailed with the identity specimen.

It is recognized that the Employer has the right to request the clinic personnel administering a urine drug test to take such steps as checking the color and temperature of the urine specimen(s) to detect tampering or substitutionexpense, provided that the employee’s right of privacy is guaranteed, and in no circumstances may observation take place while laboratory chosen by the employee must be licensed by the California Department of Health Services, Laboratory Field Services. The cost of testing the third sample shall be borne by the employee or applicant.
C. The specific required procedure is producing as follows:
1. Urine shall be obtained directly in a tamper-resistant urine bottle. Alternatively, the urine specimens. If it is established that specimen may be collected at the employee’s option in a wide-mouthed clinic specimen has been intentionally tampered with or substituted by the employee, the employee is subject to discipline as if the specimen tested positive. The employee shall be permitted no more than two (2) hours to give a sample. If the second (2nd) laboratory report is negative, the employee will be reimbursed for the cost of the second (2nd) test labeled and for all lost time.
h. All specimen samples shall be sealed, labeled, then initialed by the employee and witnesses. If the sample must be collected at a site other than the drug and/or alcohol-testing laboratory, the specimen shall then be placed in a transportation container. The container shall be sealed in the employee’s presence and the employee shall be asked to initial or sign the container. The container shall be sent to the designated testing laboratory technicianon that day or the earliest business day by the fastest available method. The same procedure shall be followed for a blood test.
3. A chain of possession form shall be completed by the hospital, laboratory and/or clinic personnel during the specimen collection and checked against attached to and mailed with the identity specimen.

Drug Testing Procedures. a. Comcast shall identify and select only qualified medical laboratories certified DHHS/NIDA/SAMHSA to perform the urinalysis testing described by these procedures. The Comcast Department Human Resources will coordinate appointments for urine collection for drug screens. The specimens will be collected at special facilities that optimize confidentially and observe DOT collection procedures. The collection facility must adhere to the collection provisions set forth in the “DHHS” regulations entitled “Mandatory Guidelines for Federal Work Place Drug Testing Programs” 53 FR (I 1970) published April 11, 1988 known as “DHHS guidelines” and 49 CFR part 40, as amended. A strict chain of custody will be maintained on the specimen as described in the “DHHS Guidelines”. In the event that the non-designated collection facility must be used, the supervising employee contacting the facility must insure that the facility is properly advised concerning the collection requirements as described in the “DHHS Guidelines”. Record keeping and reporting of all drug testing procedures and safeguards provided in this policy results shall be adhered in strict accordance with Federal guidelines to protect the confidentiality of the employees. If there is concern about an individual’s ability to function safely, that individual will be provided transportation to his or her home after completion of the drug testing. Supervisors will always transport employees to the collection site. Visual observations of an applicant or employee producing a urine specimen may be made by a health care provider of the same gender if there is reason to believe that the specimen may be adulterated. Test samples will be analyzed by a Department of Health and Human Services (DHHS) certified laboratory utilizing scientifically reliable technology or any laboratory personnel administering departmental drug tests.
b. Laboratory personnel authorized other procedure as permitted by law. Where a positive result is confirmed, urine specimens shall be maintained in secured, frozen storage for a minimum of one (1) year determined by the date of final disposition and statute of limitations for appeal if applicable.
3.6.1 The urine sample first shall be tested using the initial drug screening procedure. An initial positive test result will not be considered conclusive; rather, it will be classified as “confirmation pending” until the confirmation test results are obtained.
3.6.2 A specimen testing positive will undergo an additional confirmatory test.
3.6.3 The drug screening tests selected shall be capable of identifying marijuana, cocaine, and checked against every major drug of abuse including heroin, amphetamine and barbiturates. Personnel utilized for testing will be certified as qualified to collect urine samples or adequately trained in collection procedures.
3.6.4 Drug testing levels will be in accordance with current federal DOT Guidelines for Marijuana, Cocaine, Amphetamines, Opiates, and POP. Record keeping and reporting of all drug testing procedures and safeguards provided in this policy results shall be adhered in strict accordance with Federal guidelines to protect the confidentiality of the employees. If there is concern about an individual’s ability to function safely, that individual will be provided transportation to his or her home after completion of the drug testing. Supervisors will always transport employees to the collection site. Visual observations of an applicant or employee producing a urine specimen may be made by a health care provider of the same gender if there is reason to believe that the specimen may be adulterated. Test samples will be analyzed by a Department of Health and Human Services (DHHS) certified laboratory utilizing scientifically reliable technology or any laboratory personnel administering departmental drug tests.
b. Laboratory personnel authorized other procedure as permitted by law. Within 72 hours following a Medical Review Officer’s (MRO) notice to administer departmental drug tests shall require an employee that he/she has tested positive identification from each employee to be tested before drugs, the employee enters or the testing area.
c. In the case of an alcohol test other than a blood alcohol test, a pre-second confirmatory test interview shall be conducted by testing personnel to ascertain and document if the result shows .04 or greater grams of alcohol per 210 liters of breath in the employee’s recent use of any prescription or non-prescription drugs, or any indirect exposure to drugs.

e. It is recognized that the Employer has the right to request the clinic personnel administering a urine drug test to take such steps as checking the color and temperature greater than 30 minutes after completion of the urine specimen(s) to detect tampering or substitution, provided that the employee’s right of privacy is guaranteed, and in no circumstances may observation take place while the employee is producing the urine specimensfirst test. If it is established that the employee’s specimen has been intentionally tampered with or substituted by the employee, the employee is subject to discipline as if the specimen tested positive. In order to deter adulteration of the urine specimen during the collection process, physiologic determinations such as creatinine, specific gravity and/or chloride measurements may A copy will be performed by the laboratory. Any findings by the laboratory outside the “normal” ranges for creatinine, specific gravity and/or chloride shall be immediately reported to the Employer so that another specimen can be collected without undue delay. f. Where the employee appears unable or unwilling to give a specimen at the time of the test, testing personnel shall document the circumstances on the drug-test report form. The employee shall be permitted no more than two (2) hours to give a sample. During that time, the employee shall remain in the testing area, which shall remain under the observation and control of the clinic personnel. Direct observation of the employee producing the sample is prohibited. Reasonable amounts of water may be promptly given to the employee to encourage urination. Failure to submit a sample shall be considered a refusal to submit to a drug test except for good cause as determined by the MROemployee.
g. Urine in excess of the first 60ml shall be placed in a second container by authorized testing personnel. The samples must be provided at the same time, and marked and placed in identical specimen containers by authorized testing personnel. One sample shall be submitted for immediate drug testing. The other sample shall remain at the facility in frozen storage. If an employee is told that the first (1st) sample tested positive, the employee may, within seventy-two (72) hours of receipt of actual notice, request that the second (2nd) urine specimen be forwarded by the first (1st) laboratory to another independent and unrelated approved laboratory of the parties’ choice for Gas Chromotoyraby/Mass Spectremetry (GC/MS) confirmatory testing of the presence of the drug. If the employee requests a second test, he shall simultaneously pay to the Employer the cost of the second test. The employee may be suspended without pay once the first (1st) laboratory reports a positive finding while the second (2nd) test is being performed. If the second (2nd) laboratory report is negative, the employee will be reimbursed for the cost of the second (2nd) test and for all lost time.
h. All specimen samples shall be sealed, labeled, initialed by the employee and laboratory technician, and checked against the identity of the employee. Samples shall be stored in a secured and refrigerated atmosphere until testing or delivery to the testing lab representative.

Drug Testing Procedures. a. (a) The testing procedures and safeguards provided in this policy to ensure the integrity of department drug testing shall be adhered to by any laboratory personnel administering departmental drug tests.
