Common use of DURATION AND INTENT Clause in Contracts

DURATION AND INTENT. A. This Master Agreement and the appendices hereto constitute the whole agreement between the Board and the Association and shall become effective July 1, 2024, and shall remain in full force and effect through June 30, 2027. B. Should the State Employment Relations Board or any court of competent jurisdiction, determine, after all appeals or times for appeal have been exhausted, that any provision herein is unlawful, such provision or portion thereof, shall be automatically terminated but all other provisions of the Master Agreement shall remain in full force and effect. C. The Board and the Association acknowledge that during the negotiations that preceded this Master Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter within the scope of the Collective Bargaining Law and that all the understandings and agreements arrived at by the parties after the exercise of the right and opportunity are set forth in the written provisions of this Master Agreement. Any matter affecting the bargaining unit members not changed by this Master Agreement will remain unchanged for the period of this Master Agreement except as changed by agreement of the Board and the Association. D. Both parties and their constituents agree to comply with the provisions of this Master Agreement. This Master Agreement shall be the base for future agreements; therefore, any item not changed by mutual agreement will automatically carry forward in writing to the next Master Agreement. E.
