Duration and Scope of Section 5. 3. Insomuch as certain of the provisions of Section 5.3 are intended to apply to Gxxxxxxx and any Gxxxxxxx Licensee, and Palomar and any Palomar Licensee, this Section 5.5 sets forth the general principles for the duration and scope of Section 5.3:

Duration and Scope of Section 5. 3. Insomuch as certain of the provisions of Section 5.3 are intended to apply to Xxxxxxxx and any Xxxxxxxx Licensee, and Palomar and any Palomar Licensee, this Section 5.5 sets forth the general principles for the duration and scope of Section 5.3: (a) For as long as Xxxxxxxx or a Palomar Licensee has an exclusive (sub)license under a license granted to it by Palomar under the Palomar Technology or Joint Technology (as the case may be) sufficient in scope to Exploit, in the case of Xxxxxxxx, Female Products, and in the case of the Palomar Licensee (other than with respect to any Joint Excluded Technology), Light-Based Products outside the Field, then the Person receiving such license shall enjoy the benefits of the restrictions contained in Section 5.3(a) or 5.3(b), respectively, (i.e., as long as the licenses grants in Section 4.1(a)(i) and 4.1(a)(ii) remain exclusive to Xxxxxxxx, Xxxxxxxx shall enjoy the benefit of the restrictions contained in Section 5.3(a)). At such time as Xxxxxxxx or the Palomar Licensee, as the case may be, no longer has any such exclusive license, then Xxxxxxxx or the Palomar Licensee shall no longer enjoy the benefits of such restrictions. (b) For as long as Xxxxxxxx or a Palomar Licensee is granted a (sub)license by Palomar, whether exclusive or non-exclusive in scope, under the Palomar Technology or Joint Technology sufficient in scope to Exploit, in the case of Xxxxxxxx, Female Products, and in the case of the Palomar Licensee (other than with respect to any Joint Excluded Technology), Light-Based Products outside the Field, then Xxxxxxxx or the Palomar Licensee, respectively, shall be subject to the restrictions contained in Section 5.3(a) or 5.3(b), as applicable (i.e., so long as the license grants in Section 4.1(a)(i) and 4.1(a)(ii) remain in force, Xxxxxxxx shall be subject to the restrictions contained in Section 5.3(b)).
